수산업법 제26조(어업권의 경매)

① 제30조제2항, 제34조제2호부터 제5호까지 또는 같은 조 제6호(제33조제1항제8호 또는 제9호에 해당하는 경우에만 해당한다)에 따라 어업의 면허를 취소한 경우 그 어업권의 저당권자로 등록된 자는 제35조에 따른 통지를 받은 다음 날부터 계산하기 시작하여 30일 이내에 어업권의 경매를 신청할 수 있다.

② 제1항에 따라 경매를 신청한 경우에는 해당 어업권은 면허를 취소한 날부터 경매절차가 끝난 날까지 경매의 목적의 범위에서 존속하는 것으로 본다.

③ 경매에 따른 경매대금 중 경매비용과 제1항의 저당권자에 대한 채무를 변제하고 남은 금액은 국고에 귀속한다.

(3) Of어^v브 the^ð더 proceeds프^r러시즈 of어^v브 the^ð디 auction,악션 the^ð디 amount어마운트 remaining^r리메이닝 after애^f프터 paying페이잉 the^ð디 auction악션 costs카스츠 and앤드 the^ð더 debt뎃 owed오우드 to투 the^ð더 mortgagee모기지 under언더 paragraph패^r러그^r래^f프 (1) shall섈 revert^r리^v벗 to투 the^ð더 national내셔늘 treasury.트^r레저^r리

④ 경락인이 경매대금을 완납한 때에는 어업면허의 취소는 그 효력이 발생하지 아니한 것으로 본다.

(4) Where웨어 the^ð더 successful석세스^f플 bidder비더 has해즈 paid페이드 the^ð더 full^f풀 auction악션 price,프^r라이스 the^ð더 revocation^r레^v버케이션 of어^v브 the^ð더 fishing^f피슁 license라이슨스 shall섈 be비 deemed딤드 not낫 to투 have해^v브 taken테이큰 effect.이^f펙트
