수산업법 제36조(어촌계 등의 어장관리)

① 어촌계가 가지고 있는 어업권은 제37조에 따른 어장관리규약으로 정하는 바에 따라 그 어촌계의 계원이 행사한다. 다만, 마을어업권의 경우에는 계원이 아닌 자도 다음 각 호의 요건을 모두 갖춘 경우에는 마을어업권을 행사할 수 있다.

② 지구별수협이 가지고 있는 어업권은 대통령령으로 정하는 경우 외에는 제37조에 따른 어장관리규약으로 정하는 바에 따라 그 어장에 인접한 지역을 업무구역으로 하는 어촌계의 업무구역에 주소를 두고 있는 그 지구별수협의 조합원이 행사한다.

③ 제1항 및 제2항에 따른 어업권의 행사방법과 행사의 우선순위, 어촌계별ㆍ어촌계원별ㆍ조합원별 시설량 또는 구역의 조정(調整), 그 밖에 어장관리에 필요한 사항은 해양수산부령으로 정한다.
