아이돌봄 지원법 시행령 제5조(권한 등의 위임 및 위탁)
Enforcement Decree of the Child Care Support Act, Article 5 (Delegation and Entrustment of Authority, etc.)
① 성평등가족부장관은 법 제34조제1항에 따라 다음 각 호의 권한을 법 제11조제1항에 따라 아이돌봄서비스제공기관을 지정한 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사ㆍ특별자치도지사(이하 "시ㆍ도지사"라 한다)ㆍ시장ㆍ군수ㆍ구청장(자치구의 구청장을 말한다. 이하 같다)에게 위임한다. <신설 2026.4.21>
(1) Pursuant to Article 34 (1) of the Act, the Minister of Gender Equality and Family shall delegate the following authority to the Mayor of a Special Metropolitan City, Metropolitan City, or Special Self-Governing City, the Do Governor, or the Special Self-Governing Province Governor (hereinafter referred to as the "Mayor/Do Governor") or the head of a Si/Gun/Gu (referring to the head of an autonomous Gu; hereinafter the same shall apply) who designated a child care service provider institution pursuant to Article 11 (1) of the Act:
1. 법 제11조제1항에 따라 지정된 아이돌봄서비스제공기관에서 아이돌봄사로 활동하려는 사람에 대한 법 제6조의2제2항 본문에 따른 범죄경력조회 요청에 관한 권한
1. Authority concerning requests for criminal record checks under the main text of Article 6-2 (2) of the Act on persons intending to work as child care providers at a child care service provider institution designated pursuant to Article 11 (1) of the Act;
2. 법 제11조제1항에 따라 지정된 아이돌봄서비스제공기관의 업무에 종사하려는 사람에 대한 법 제11조의5제2항 본문에 따른 범죄경력조회 요청에 관한 권한
2. Authority concerning requests for criminal record checks under the main text of Article 11-5 (2) of the Act on persons intending to engage in the work of a child care service provider institution designated pursuant to Article 11 (1) of the Act.
② 성평등가족부장관은 법 제34조제1항에 따라 다음 각 호의 권한을 법 제11조의2제1항에 따라 아이돌봄서비스제공기관을 등록한 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 위임한다. <신설 2026.4.21>
(2) Pursuant to Article 34 (1) of the Act, the Minister of Gender Equality and Family shall delegate the following authority to the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu who registered a child care service provider institution pursuant to Article 11-2 (1) of the Act:
1. 법 제11조의2제1항에 따라 등록된 아이돌봄서비스제공기관에서 아이돌봄사 또는 육아도우미로 활동하려는 사람에 대한 법 제6조의2제2항 본문에 따른 범죄경력조회 요청에 관한 권한
1. Authority concerning requests for criminal record checks under the main text of Article 6-2 (2) of the Act on persons intending to work as child care providers or parenting helpers at a child care service provider institution registered pursuant to Article 11-2 (1) of the Act;
2. 법 제11조의2제1항에 따라 등록된 아이돌봄서비스제공기관의 업무에 종사하려는 사람에 대한 법 제11조의5제2항 본문에 따른 범죄경력조회 요청에 관한 권한
2. Authority concerning requests for criminal record checks under the main text of Article 11-5 (2) of the Act on persons intending to engage in the work of a child care service provider institution registered pursuant to Article 11-2 (1) of the Act.
③ 성평등가족부장관은 법 제34조제1항에 따라 법 제11조의5제2항 본문에 따른 권한으로서 법 제10조의4제1항에 따라 지정된 아이돌봄광역지원센터의 업무에 종사하려는 사람에 대한 범죄경력조회 요청에 관한 권한을 시ㆍ도지사에게 위임한다. <신설 2026.4.21>
(3) Pursuant to Article 34 (1) of the Act, the Minister of Gender Equality and Family shall delegate to the Mayor/Do Governor, as authority under the main text of Article 11-5 (2) of the Act, the authority concerning requests for criminal record checks on persons intending to engage in the work of a wide-area child care support center designated pursuant to Article 10-4 (1) of the Act.
④ 성평등가족부장관은 법 제34조제2항에 따라 법 제32조 및 제33조에 따른 아이돌봄사의 자격정지 및 자격취소에 관한 권한을 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 위임한다. <개정 2026.4.21>
(4) Pursuant to Article 34 (2) of the Act, the Minister of Gender Equality and Family shall delegate the authority concerning suspension and revocation of the qualification of child care providers under Articles 32 and 33 of the Act to the Special Self-Governing City Mayor, the Special Self-Governing Province Governor, or the head of a Si/Gun/Gu.
⑤ 성평등가족부장관은 법 제34조제3항에 따라 다음 각 호의 업무를 한국건강가정진흥원에 위탁한다. <신설 2026.4.21>
(5) Pursuant to Article 34 (3) of the Act, the Minister of Gender Equality and Family shall entrust the following affairs to the Korea Institute for Healthy Family:
1. 법 제6조의2제1항에 따른 아이돌봄사가 되려는 사람에 대한 범죄경력조회 요청에 관한 업무
1. Affairs concerning requests for criminal record checks under Article 6-2 (1) of the Act on persons intending to become child care providers;
2. 법 제7조에 따른 아이돌봄사 자격관리에 관한 다음 각 목의 업무
2. The following affairs concerning management of child care provider qualifications under Article 7 of the Act:
가. 적성ㆍ인성 검사 도구의 개발 및 해당 검사의 실시
(a) Development of aptitude and personality test tools and administration of the tests;
나. 아이돌봄사의 자격검정
(b) Qualification examination of child care providers;
다. 아이돌봄사 자격증의 발급
(c) Issuance of child care provider certificates;
3. 법 제10조제1항에 따라 실시하는 보수교육의 관리 및 지원
3. Management and support of refresher training conducted pursuant to Article 10 (1) of the Act.
⑥ 성평등가족부장관은 법 제34조제3항에 따라 법 제10조제1항에 따른 아이돌봄사 보수교육을 법 제9조제1항에 따라 지정된 교육기관이나 아이돌봄서비스제공기관에 위탁한다. 이 경우 성평등가족부장관은 위탁받는 기관 및 위탁업무의 내용을 고시해야 한다. <개정 2025.10.1, 2026.4.21>
(6) Pursuant to Article 34 (3) of the Act, the Minister of Gender Equality and Family shall entrust refresher training for child care providers under Article 10 (1) of the Act to educational institutions designated pursuant to Article 9 (1) of the Act or child care service provider institutions. In such cases, the Minister of Gender Equality and Family shall publicly notify the entrusted institutions and the details of the entrusted affairs.
⑦ 성평등가족부장관은 법 제34조제3항에 따라 다음 각 호의 업무를 「사회보장급여의 이용ㆍ제공 및 수급권자 발굴에 관한 법률」 제29조제1항에 따른 한국사회보장정보원에 위탁한다. <개정 2021.12.31, 2025.10.1, 2026.4.21>
(7) Pursuant to Article 34 (3) of the Act, the Minister of Gender Equality and Family shall entrust the following affairs to the Korea Social Security Information Service under Article 29 (1) of the Act on the Use and Provision of Social Security Benefits and Identification of Eligible Persons:
1. 법 제23조제1항에 따른 금융정보등의 제공 요청에 관한 업무
1. Affairs concerning requests for provision of financial information, etc. under Article 23 (1) of the Act;
2. 법 제24조제2항에 따른 자료의 제공 요청에 관한 업무
2. Affairs concerning requests for provision of data under Article 24 (2) of the Act.
