어선원 및 어선 재해보상보험법 시행령 제25조의2(다른 보상이나 배상과의 조정 기준)

① 법 제31조제3항에서 "그 받은 금품을 대통령령으로 정하는 방법에 따라 환산한 금액"이란 그 받은 금품을 각각 손해배상액 산정 당시의 승선평균임금으로 나눈 일수(그 일수 중 수급권자에게 지급할 해당 보험급여에 따른 각각의 지급일수를 초과하는 일수는 제외한다)에 해당하는 보험급여의 금액을 말한다. 이 경우 그 받은 금품이 요양이면 그 요양에 드는 비용으로 환산한 금액으로 한다.

② 제1항을 적용할 때 수급권자에게 지급할 보험급여가 부상 및 질병급여이면 부상 및 질병급여의 금액을 그 보험급여액 산정 당시의 승선평균임금으로 나눈 일수를 해당 보험급여의 지급일수로 보고, 그 승선평균임금을 해당 보험급여의 1일분 급여액으로 본다. <개정 2021.12.14>
