Enforcement Decree of the Act on Promotion of Production and Use of Biogas from Organic Waste Resources, Article 5 (Requests for Provision of Data)
기후에너지환경부장관은 민간의무생산자를 정하거나 법 제5조제2항 및 제3항에 따라 바이오가스 생산목표를 산정하기 위해 필요한 경우에는 관계 중앙행정기관 및 지방자치단체의 장에게 다음 각 호의 자료의 제공을 요청할 수 있다. 이 경우 요청받은 중앙행정기관 및 지방자치단체의 장은 정당한 사유가 없으면 이에 따라야 한다. <개정 2025.10.1>
Where necessary to determine private mandatory producers or to calculate the biogas production target under Article 5 (2) and (3) of the Act, the Minister of Climate, Energy and Environment may request the heads of the relevant central administrative agencies and local governments to provide the following data. In this case, the heads of the central administrative agencies and local governments so requested shall comply, unless there is a justifiable reason:
1. 「가축 및 축산물 이력관리에 관한 법률」 제27조제2항에 따른 이력관리시스템에서 보유하고 있는 농장경영자 정보, 가축사육시설의 소재지, 가축 사육두수 등 가축사육시설에 관한 자료
1. Data on livestock raising facilities held in the traceability management system under Article 27 (2) of the Act on Livestock and Livestock Products Traceability, such as farm operator information, the location of livestock raising facilities, and the number of livestock raised;
2. 국가 또는 지방자치단체의 재정적 지원을 받아 설치한 「가축분뇨의 관리 및 이용에 관한 법률」 제2조제8호에 따른 처리시설의 가축분뇨 축종별 반입량, 처리 유형별 현황 등 가축분뇨 처리 현황에 관한 자료
2. Data on the status of livestock excreta treatment of treatment facilities under Article 2, subparagraph 8 of the Act on the Management and Use of Livestock Excreta that were installed with financial support from the State or a local government, such as the intake of livestock excreta by livestock species and the status by treatment type;
3. 그 밖에 기후에너지환경부장관이 필요하다고 인정하는 자료
