의무경찰대 설치 및 운영에 관한 법률 제9조(벌칙)

① 다음 각 호의 어느 하나에 해당하는 사람은 1년 이상 10년 이하의 징역에 처한다. 다만, 전시ㆍ사변 또는 간첩의 출현으로 작전에 동원된 경우 각 호의 어느 하나에 해당하는 사람은 5년 이상의 유기징역에 처한다.

② 직무상 공격하여야 할 적을 정당한 사유 없이 공격하지 아니하거나 직무상 당면(當面)하여야 할 위난(危難)으로부터 이탈한 사람은 무기 또는 1년 이상의 징역에 처한다.

③ 정당한 사유 없이 초소를 이탈한 사람은 2년 이하의 징역에 처한다. 다만, 전시ㆍ사변 또는 간첩의 출현으로 작전에 동원된 경우 본문의 죄를 저지른 사람은 1년 이상의 유기징역에 처한다.

④ 정당한 사유 없이 근무수칙을 위반하여 직무를 게을리한 사람은 1년 이하의 징역에 처한다. 다만, 전시ㆍ사변 또는 간첩의 출현으로 작전에 동원된 경우 본문의 죄를 저지른 사람은 5년 이하의 징역에 처한다.

⑤ 근무를 기피할 목적으로 신체를 상해(傷害)한 사람은 3년 이하의 징역에 처한다. 다만, 적전(敵前)인 경우 본문의 죄를 저지른 사람은 사형ㆍ무기 또는 5년 이상의 징역에 처한다.

⑥ 근무를 기피할 목적으로 꾀병이나 그 밖의 속임수를 쓴 사람은 1년 이하의 징역에 처한다. 다만, 적전인 경우 본문의 죄를 저지른 사람은 10년 이하의 징역에 처한다.

⑦ 직무에 관하여 거짓으로 통보 또는 보고를 한 사람은 1년 이하의 징역에 처한다. 다만, 전시ㆍ사변 또는 간첩의 출현으로 작전에 동원된 경우 본문의 죄를 저지른 사람은 7년 이하의 징역에 처한다.
