인감증명법 시행령 제13조(인감증명서의 발급)

1. 인감을 신고한 자가 피성년후견인인 경우에는 성년후견인이 방문하여 신청하여야 한다.

3. 인감을 신고한 자가 피한정후견인인 경우에는 별지 제13호서식, 별지 제13호의2서식 또는 별지 제13호의3서식에 따른 한정후견인의 동의서[한정후견인이 재외국민인 경우로서 해외에 체류 중인 경우 또는 한정후견인이 해외거주(체류)자인 경우에는 동의사실에 대하여 재외공관의 확인을 받은 것을 말하고, 한정후견인이 수감 중인 경우에는 수감기관의 확인을 받은 것을 말한다]와 한정후견인의 주민등록증등을 제출하여야 한다. 다만, 발급받으려는 인감증명서의 용도가 한정후견인의 동의가 필요한 사항인 경우로 한정한다.

4. 인감을 신고한 자가 피한정후견인이고 등기사항증명서에 한정후견인이 인감증명서 발급에 관한 대리권을 행사할 수 있다고 기재된 경우에는 한정후견인이 피한정후견인의 인감증명서 발급을 신청할 수 있다.

5. 인감을 신고한 자(본인으로 한정하며, 피성년후견인, 미성년자 및 피한정후견인을 제외한다)가 「민원 처리에 관한 법률」 제12조의2제2항 및 제3항에 따른 전자민원창구 및 통합전자민원창구(이하 "전자민원창구"라 한다)를 통해 인감증명서 발급을 신청해 인감증명서를 전자문서로 발급받으려는 경우에는 부동산 매도용 또는 자동차(「자동차관리법」 제5조에 따라 등록된 자동차를 말한다. 이하 이 호 및 제3항에서 같다) 매도용이 아닌 용도의 인감증명서 중 다음 각 목에 해당하지 않는 경우에만 발급을 신청할 수 있다. 이 경우 인감증명서의 발급용도와 제출처를 기재해 발급을 신청해야 한다.

2. 미성년자가 신청하는 경우에는 그 법정대리인의 동의 여부를 반드시 확인하고, 피한정후견인이 신청하는 경우에는 한정후견인의 동의 여부를 반드시 확인한다.

3. 복사방지를 위한 특수용지를 사용하여 별지 제14호서식의 인감증명서를 발급한다. 이 경우 발급하는 인감증명서가 피한정후견인의 인감증명서일 때에는 반드시 담당 공무원이 신청인에게 용도를 확인한 후 직접 인감증명서에 용도를 기재하여 발급한다.

4. 별지 제15호서식의 인감증명서발급대장에 수령인이 본인인 경우에는 서명 또는 무인을, 대리인인 경우에는 무인을 받은 후 인감증명서를 교부한다. 이 경우 수령인이 본인인 경우에는 전산에 의하여 관리되는 인감증명서발급대장에 전자이미지서명입력기를 사용한 서명을 받을 수 있다.
