재난 및 안전관리 기본법 제76조의4(재난안전의무보험 종합정보시스템의 구축ㆍ운영 등)

① 행정안전부장관은 재난안전의무보험 관리ㆍ운용의 효율성을 높이고, 재난안전의무보험 관련 자료 또는 정보를 체계적으로 수집하여 종합적으로 관리할 수 있도록 재난안전의무보험 종합정보시스템을 구축ㆍ운영할 수 있다.

② 행정안전부장관은 제1항에 따른 재난안전의무보험 종합정보시스템의 구축ㆍ운영을 위하여 필요한 경우에는 관계 중앙행정기관의 장, 지방자치단체의 장, 공공기관, 보험사업자 또는 「보험업법」에 따른 보험 관계 단체의 장 등에게 관련 자료 또는 정보의 제공을 요청하거나 그가 관리ㆍ운영하는 재난안전의무보험 관련 전산시스템과 연계하여 자료 또는 정보를 수집할 수 있다. 이 경우 관련 자료 또는 정보의 제공을 요청받거나 전산시스템과의 연계 요청을 받은 자는 「개인정보 보호법」 제18조제1항에도 불구하고 특별한 사유가 없으면 이에 따라야 한다.

③ 행정안전부장관은 「개인정보 보호법」 제18조제1항에도 불구하고 이 조 제1항에 따른 재난안전의무보험 종합정보시스템에 수집된 자료 또는 정보를 다른 재난관리책임기관과 공동이용할 수 있고, 보험사업자 또는 「보험업법」에 따른 보험 관계 단체 등이 재난안전의무보험 관련 업무의 수행을 위하여 자료 또는 정보의 제공을 요청하는 경우 그 사용 목적에 해당하는 범위에서 관련 자료 또는 정보를 제공할 수 있다.

④ 제3항에 따라 재난안전의무보험 관련 자료 또는 정보를 공동이용하거나 제공받은 자(관련 업무를 위탁받아 그 업무에 종사하거나 종사하였던 자를 포함한다)는 업무상 알게 된 재난안전의무보험 관련 자료 또는 정보를 누설하거나 권한 없이 다른 사람이 이용하도록 제공하는 등 부당한 목적으로 사용해서는 아니 된다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 재난안전의무보험 종합정보시스템의 구축ㆍ운영, 재난안전의무보험 관련 자료 또는 정보의 공동이용 및 제공 등에 필요한 사항은 대통령령으로 정한다.
