1. 해당 권리에 대하여 법 제24조제2항에 따른 소멸시효가 완성된 경우

3. 체납처분의 목적물인 총재산이 부당이득금보다 우선하는 국세, 지방세, 전세권ㆍ질권ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권에 따라 담보된 채권 등의 변제에 충당하고 나면 남을 여지가 없음이 확인된 경우
