Enforcement Decree of the Act on the Promotion of the Development, Use, and Distribution of Renewable Energy, Article 27-3 (Setback Distances for Renewable Energy Power Generation Facilities|9)

① 법 제27조의3제1항제3호에서 "대통령령으로 정하는 경우"란 다음 각 호의 경우를 말한다.

1. 태양광을 이용한 발전설비(이하 이 조에서 "태양광발전설비"라 한다)를 설치하기 위한 경우: 태양광발전설비의 부지 경계선으로부터 반경 200미터까지의 범위에서 해당 지방자치단체의 조례로 발전설비와 주택 간 이격거리를 정하는 경우. 다만, 그 이격거리 내에 기후에너지환경부장관이 정하여 고시하는 주택이 해당 조례로 정하는 호수(최소 5호로 한다) 미만으로 있는 경우 해당 주택에 대해서는 이격거리를 적용하지 않는다.

가. 풍력발전설비의 부지 경계선으로부터 반경 1,500미터까지(최소 해당 발전설비 높이의 2배 이상이어야 한다)의 범위에서 해당 지방자치단체의 조례로 발전설비와 주택 간 이격거리를 정하는 경우. 다만, 그 이격거리 내에 기후에너지환경부장관이 정하여 고시하는 주택이 해당 조례로 정하는 호수(최소 5호로 한다) 미만으로 있는 경우 해당 주택에 대해서는 이격거리를 적용하지 않는다.
