정보통신공사업법 시행령 제35조의2(착공전 설계도 확인)

① 법 제36조제1항에 따라 설계도의 확인을 받으려는 자는 정보통신공사 착공전 설계도 확인 신청서(전자문서로 된 신청서를 포함한다)에 공사의 설계도 사본(전자문서로 된 설계도를 포함한다)을 첨부하여 해당 정보통신공사를 시작하기 전에 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 제출하여야 한다.

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 설계도의 확인 요청을 받은 경우에는 설계도의 내용이 법 제6조에 따른 기술기준(이하 이 조에서 "기술기준"이라 한다)에 적합한지 여부를 확인하여야 한다.

③ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제2항에 따른 정보통신공사 설계도의 확인 결과를 제1항에 따른 신청인에게 알리려는 경우에는 과학기술정보통신부령으로 정하는 정보통신공사 착공전 설계도 확인결과 통보서에 적어 알려야 하며, 해당 공사의 설계가 기술기준에 미달하는 등 시공에 부적합하다고 인정하는 경우에는 통보서에 확인의견 및 보완사항 등의 내용을 적어 알려야 한다. <개정 2017.7.26>

④ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제3항에 따라 정보통신공사 설계도 확인결과를 알린 경우에는 정보통신공사 착공전 설계도 확인업무 관리대장에 이를 일련번호순으로 기록하여야 한다.
