지방공무원 교육훈련법 시행령 제12조(교육훈련과 인사관리)

① 지방자치단체의 장(소속 기관의 장을 포함한다)과 지방의회의 의장은 신규임용후보자 및 신규임용자를 담당 직급과 직무에 보직(補職)할 때에는 그 직급과 직무분야에 상응하는 기본교육훈련과정을 이수하게 한 후에 보직해야 한다. <개정 2021.11.30>

② 지방자치단체의 장과 지방의회의 의장은 5급 공무원으로의 승진임용을 할 때에는 특별한 사유가 없으면 5급 승진후보자 기본교육훈련과정을 이수한 사람 중에서 승진임용해야 한다. <개정 2021.11.30>

③ 지방자치단체의 장과 지방의회의 의장은 특별한 사유가 없으면 교육훈련을 받은 지방공무원을 교육훈련 이수분야와 관련된 분야에 보직해야 한다. <개정 2021.11.30>

④ 지방자치단체의 장과 지방의회의 의장은 위탁교육훈련을 실시할 때에는 교육훈련 이수 후의 보직 분야를 미리 지정하여 교육훈련을 실시하고, 교육훈련 이수 후에는 특별한 사유가 없으면 그 분야에 보직해야 한다. <개정 2021.11.30>
