지방공무원 교육훈련법 시행령 제35조(의무위반 등에 대한 소요경비 반납조치)

Enforcement Decree of the Local Public Officials Education and Training Act, Article 35 (Measures for Refund of Required Expenses for Breach of Duties, etc.)

① 지방자치단체의 장과 지방의회의 의장은 위탁교육훈련 중이거나 위탁교육훈련을 마친 공무원이 다음 각 호의 어느 하나에 해당하게 된 경우에는 별표 2에서 정하는 반납액 산정기준의 범위에서 조례로 정하는 바에 따라 해당 공무원의 위탁교육훈련에 든 경비의 전액 또는 일부를 본인으로 하여금 반납하게 해야 한다. <개정 2021.11.30>

1. 훈련 중 면직된 경우(질병ㆍ사고 등 부득이한 사유로 인하여 면직된 경우는 제외한다)

3. 제33조에 따라 복귀명령을 받고도 정당한 사유 없이 지정된 날까지 복귀하지 아니하거나 복귀 후에 교육훈련 중 발생한 사유로 인하여 면직된 경우

② 지방자치단체의 장과 지방의회의 의장은 위탁교육훈련 중이거나 위탁교육훈련을 마친 공무원 본인이 그 경비의 전액 또는 일부를 반납하지 않을 경우 그의 보증인(「보험업법」에 따라 보증보험증권을 발행한 보험회사를 포함한다)에게 보증채무의 이행을 청구할 수 있다. <신설 2021.11.30>
