지방자치법 제24조(변상명령 등)

① 지방자치단체의 장은 제22조제2항제4호 단서에 따른 소송에 대하여 변상할 것을 명하는 판결이 확정되면 판결이 확정된 날부터 60일 이내를 기한으로 하여 당사자에게 그 판결에 따라 결정된 금액을 변상할 것을 명령하여야 한다.

② 제1항에 따라 변상할 것을 명령받은 자가 같은 항의 기한까지 변상금을 지급하지 아니하면 지방세 체납처분의 예에 따라 징수할 수 있다. <개정 2021.10.19>

③ 제1항에 따라 변상할 것을 명령받은 자는 그 명령에 불복하는 경우 행정소송을 제기할 수 있다. 다만, 「행정심판법」에 따른 행정심판청구는 제기할 수 없다.
