지방자치법 제99조(징계의 요구)

① 지방의회의 의장은 제98조에 따른 징계대상 지방의회의원이 있어 징계 요구를 받으면 윤리특별위원회에 회부한다.

② 제95조제1항을 위반한 지방의회의원에 대하여 모욕을 당한 지방의회의원이 징계를 요구하려면 징계사유를 적은 요구서를 지방의회의 의장에게 제출하여야 한다.
