Enforcement Decree of the Act on the Establishment and Operation of Executive Agencies, Article 4 (Appointment Contracts for Agency Heads, etc.)

① 기관장 임용계약서에는 다음 각 호의 사항이 포함되어야 한다. <개정 2010.3.31, 2016.2.11>

② 기관장의 임용에 관하여는 「공무원임용령」 제22조의4제2항을 적용하지 아니한다. <개정 2013.12.11, 2016.2.11>

③ 법 제7조제6항에 따른 임용은 「공무원임용령」 제16조제1항제1호에도 불구하고 기관장의 근무기간이 만료되거나 법 제8조의2제3항제1호에 따라 면직된 날부터 3년 이내에 임용되는 경우로 한정한다. <신설 2011.6.7, 2011.11.1, 2016.2.11>

④ 법 제7조제6항에 따라 경력경쟁채용을 할 때 임용을 위한 결원이 없는 경우에는 최초로 결원이 발생할 때까지 정원이 따로 있는 것으로 보고 임용할 수 있다. <신설 2020.7.21>
