토양환경보전법 시행령 제17조의4(토양정화업의 등록요건 등)

① 법 제23조의7제1항에 따라 토양정화업의 등록 또는 변경등록을 하려는 자는 기후에너지환경부령으로 정하는 바에 따라 별표 2 제1호가목에 따른 사무실의 소재지를 관할하는 시ㆍ도지사에게 등록 또는 변경등록해야 한다. <개정 2025.10.1>

② 제1항에 따라 토양정화업을 등록한 시ㆍ도지사의 관할구역 외에서 별표 2 제1호나목에 따른 반입정화시설(이하 "반입정화시설"이라 한다)을 설치하여 법 제15조의3제3항 단서에 따라 오염토양을 반출하여 정화하려는 자는 기후에너지환경부령으로 정하는 바에 따라 반입정화시설의 소재지를 관할하는 시ㆍ도지사에게 등록 또는 변경등록해야 한다. <개정 2025.10.1>

③ 법 제23조의7제1항 전단에 따라 토양정화업의 등록을 하려는 자가 갖춰야 하는 시설ㆍ장비 및 기술인력은 별표 2와 같다.

④ 법 제23조의7제1항 후단에서 "대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다.

⑤ 제4항제1호부터 제3호까지의 규정에 따른 사항을 변경하려는 경우에는 변경사유가 발생한 날부터 30일 이내에 변경등록을 해야 하며, 제4항제4호 및 제5호의 사항을 변경하려는 경우에는 미리 변경등록을 해야 한다.

⑥ 시ㆍ도지사는 법 제23조의7제1항 전단에 따른 등록신청이 있을 때에는 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 등록을 해 줘야 한다.
