풍수해ㆍ지진재해보험법 시행령 제4조의2(보험료 전부 지원 대상)
Enforcement Decree of the Storm and Flood Damage and Earthquake Disaster Insurance Act, Article 4-2 (Persons Eligible for Full Support of Insurance Premiums)
법 제7조제1항 단서에서 "「국민기초생활 보장법」에 따른 수급자 또는 차상위계층이 보험목적물에 실제 거주하는 등 대통령령으로 정하는 경우"란 다음 각 호의 요건을 모두 갖춘 경우를 말한다. <개정 2024.4.23>
"Cases prescribed by Presidential Decree, such as where a recipient under the National Basic Living Security Act or a near-poverty household actually resides in the insured object" in the proviso of Article 7 (1) of the Act means cases satisfying all of the following requirements:
1. 보험목적물이 다음 각 목의 어느 하나에 해당할 것
1. The insured object must fall under any of the following:
가. 풍수해ㆍ지진재해로 피해가 발생하여 보험금이 지급된 이력이 있는 보험목적물
(a) An insured object for which damage occurred due to storm and flood damage or earthquake disaster and insurance money has been paid in the past;
나. 재난복구사업을 위하여 「재난 및 안전관리 기본법」 제66조제1항에 따라 국가 또는 지방자치단체가 부담하거나 보조하는 비용(이하 "재난지원금"이라 한다)이 지급된 이력이 있는 보험목적물
(b) An insured object for which costs borne or subsidized by the State or a local government under Article 66 (1) of the Framework Act on the Management of Disasters and Safety for disaster recovery projects (hereinafter referred to as "disaster relief funds") have been paid in the past;
다. 법 제23조제2항 각 호의 지역 내에 있는 보험목적물
(c) An insured object located within an area under any subparagraph of Article 23 (2) of the Act;
2. 다음 각 목의 어느 하나에 해당하는 사람이 제1호에 따른 보험목적물에 실제로 거주할 것
2. A person falling under any of the following must actually reside in the insured object under subparagraph 1:
가. 「국민기초생활 보장법」에 따른 수급자 또는 차상위계층
(a) A recipient under the National Basic Living Security Act, or a near-poverty household;
