학교안전사고 예방 및 보상에 관한 법률 제42조(학교안전사고의 조사 등)

①공제회는 공제급여의 지급 여부를 결정하기 위하여 필요하다고 인정하는 경우에는 소속 직원으로 하여금 학교안전사고의 발생 장소를 방문하여 사고경위 등을 조사하게 하거나 사고관계자로 하여금 필요한 서류를 제출하게 하는 등의 조사를 할 수 있다.

②공제회는 공제급여의 지급 여부를 결정하기 위하여 필요하다고 인정하는 경우에는 「국민건강보험법」 제42조의 규정에 따른 요양기관(이하 "요양기관"이라 한다)에 대하여 관계 진료기록의 열람 또는 필요한 자료의 제출을 요청할 수 있다. <개정 2011.12.31>

③제1항의 규정에 따라 조사를 하고자 하는 경우 공제회는 조사의 목적 및 내용 등을 학교안전사고가 발생한 장소의 관리자, 공제가입자, 해당 피공제자 그 밖의 사고관계자 등에게 미리 알려야 하고, 사고 발생 장소를 방문하는 공제회 소속 직원은 신분증을 제시하여야 한다. <개정 2018.12.18>

④학교안전사고가 발생한 장소의 관리자, 공제가입자, 해당 피공제자, 요양기관 또는 그 밖의 사고관계자 등은 정당한 사유 없이 제1항 또는 제2항의 규정에 따른 조사를 방해하거나 자료의 제출을 거부하여서는 아니 된다. <개정 2018.12.18>
