항만운송사업법 시행령 제27조(권한 등의 위임ㆍ위탁)
Enforcement Decree of the Port Transport Business Act, Article 27 (Delegation and entrustment of authority)
① 해양수산부장관은 법 제29조제1항에 따라 「항만법」 제3조제2항제1호에 따른 국가관리무역항 및 법 제2조제3항제2호에 따라 해양수산부령으로 수역을 정하여 지정하는 항만에서의 다음 각 호의 권한을 지방해양수산청장에게 위임한다. <개정 2013.3.23, 2017.12.26, 2018.4.30, 2022.11.15, 2023.12.12>
(1) Pursuant to Article 29 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority to the head of a Regional Office of Oceans and Fisheries with respect to nationally managed trade ports under Article 3 (2) 1 of the Harbor Act and ports designated by determining waters by Ordinance of the Ministry of Oceans and Fisheries under Article 2 (3) 2 of the Act:
1. 법 제4조제1항에 따른 항만운송사업의 등록
1. Registration of port transport businesses under Article 4 (1) of the Act;
2. 법 제5조에 따른 항만운송사업의 등록신청서 접수 및 등록증 발급
2. Acceptance of applications for registration of port transport businesses and issuance of certificates of registration under Article 5 of the Act;
3. 법 제6조 단서에 따른 한정하역사업 등록기준의 완화
3. Relaxation of registration standards for limited cargo handling businesses under the proviso of Article 6 of the Act;
4. 제10조에 따른 검수사 자격증의 발급
4. Issuance of cargo checker qualification certificates under Article 10;
5. 법 제10조에 따른 항만하역사업자에 대한 운임ㆍ요금의 인가ㆍ변경인가 및 신고수리ㆍ변경신고수리, 검수사업자에 대한 요금의 신고수리 및 변경신고수리, 운임ㆍ요금의 변경 또는 조정에 필요한 명령
5. Authorization and authorization of changes of freight rates and fees, and acceptance of reports and reports of changes, for port cargo handling business operators, and acceptance of reports and reports of changes of fees for cargo checking business operators, and orders necessary for changing or adjusting freight rates and fees, under Article 10 of the Act;
6. 법 제26조제1항에 따른 항만운송사업의 등록취소 또는 정지명령
6. Revocation of registration or orders of suspension of port transport businesses under Article 26 (1) of the Act;
6의2. 법 제26조의2제1항에 따른 항만종합서비스업의 등록
6-2. Registration of port comprehensive service businesses under Article 26-2 (1) of the Act;
6의3. 법 제26조의2제2항에 따른 항만종합서비스업의 등록신청서 접수 및 등록증 발급
6-3. Acceptance of applications for registration of port comprehensive service businesses and issuance of certificates of registration under Article 26-2 (2) of the Act;
6의4. 법 제26조의2제4항에 따른 항만종합서비스업의 등록취소 또는 정지명령
6-4. Revocation of registration or orders of suspension of port comprehensive service businesses under Article 26-2 (4) of the Act;
6의5. 법 제26조의3에 따른 항만운송관련사업의 등록, 선용품공급업의 신고수리, 항만운송관련사업의 등록신청서 등 서류의 접수 및 선박연료공급업의 사업계획 변경신고 수리
6-5. Registration of port transport-related businesses, acceptance of reports on ship supplies businesses, acceptance of applications for registration and other documents of port transport-related businesses, and acceptance of reports of changes to business plans of ship fuel supply businesses under Article 26-3 of the Act;
6의6. 법 제26조의5에 따른 항만운송관련사업의 등록취소 또는 정지명령
6-6. Revocation of registration or orders of suspension of port transport-related businesses under Article 26-5 of the Act;
6의7. 법 제27조의2에 따른 미등록 항만에서의 일시적 영업행위의 신고수리
6-7. Acceptance of reports on temporary business activities at unregistered ports under Article 27-2 of the Act;
6의8. 법 제27조의3제2항에 따른 항만운송사업 또는 항만운송관련사업에의 종사 제한
6-8. Restriction on engagement in port transport businesses or port transport-related businesses under Article 27-3 (2) of the Act;
7. 법 제27조의6에 따른 항만운송사업자 또는 항만운송관련사업자에 대한 과징금의 부과 및 징수
7. Imposition and collection of penalty surcharges on port transport business operators or port transport-related business operators under Article 27-6 of the Act;
7의2. 법 제28조의2제1항에 따른 보고 또는 자료제출의 요구, 출입ㆍ검사 또는 질문
7-2. Requests for reports or submission of data, entry and inspection, or questioning under Article 28-2 (1) of the Act;
8. 법 제29조의3제2호 및 제3호에 따른 청문
8. Hearings under Article 29-3 subparagraphs 2 and 3 of the Act;
9. 법 제34조제1항에 따른 과태료의 부과ㆍ징수
9. Imposition and collection of administrative fines under Article 34 (1) of the Act.
② 해양수산부장관은 법 제29조제1항에 따라 「항만법」 제3조제2항제2호에 따른 지방관리무역항에서의 법 제27조의3제2항에 따른 항만운송사업 또는 항만운송관련사업에의 종사 제한에 관한 권한을 시ㆍ도지사에게 위임한다. <개정 2020.9.8>
(2) Pursuant to Article 29 (1) of the Act, the Minister of Oceans and Fisheries delegates to the Mayor/Do Governor the authority concerning restriction on engagement in port transport businesses or port transport-related businesses under Article 27-3 (2) of the Act at locally managed trade ports under Article 3 (2) 2 of the Harbor Act.
③ 해양수산부장관은 법 제29조제2항에 따라 법 제7조와 이 영 제5조 및 제9조에 따른 검수사등의 자격시험에 관한 업무를 「한국산업인력공단법」에 따른 한국산업인력공단에 위탁한다. <개정 2012.7.4, 2013.3.23>
(3) Pursuant to Article 29 (2) of the Act, the Minister of Oceans and Fisheries entrusts the affairs concerning the qualification examinations for cargo checkers, etc. under Article 7 of the Act and Articles 5 and 9 of this Decree to the Human Resources Development Service of Korea under the Human Resources Development Service of Korea Act.
④ 해양수산부장관은 법 제29조제2항에 따라 법 제7조제1항에 따른 검수사등의 등록업무를 「민법」 제32조에 따라 해양수산부장관의 허가를 받아 설립된 한국검수검정협회에 위탁한다. <개정 2013.3.23>
(4) Pursuant to Article 29 (2) of the Act, the Minister of Oceans and Fisheries entrusts the registration affairs of cargo checkers, etc. under Article 7 (1) of the Act to the Korea Cargo Checking and Surveying Association established with the permission of the Minister of Oceans and Fisheries pursuant to Article 32 of the Civil Act.
⑤ 해양수산부장관은 법 제29조제2항에 따라 법 제27조의3제1항에 따른 교육훈련 업무를 법 제27조의4제1항에 따라 설립된 교육훈련기관에 위탁한다. <신설 2017.12.26>
(5) Pursuant to Article 29 (2) of the Act, the Minister of Oceans and Fisheries entrusts the education and training affairs under Article 27-3 (1) of the Act to the education and training institution established pursuant to Article 27-4 (1) of the Act.
