Enforcement Decree of the Act on the Use and Management of Beaches, Article 13 (Restriction on Use of Beaches)
법 제28조제1항 본문에서 "유해물질의 유입, 유해생물의 출현, 기상악화 등 대통령령으로 정하는 사유가 발생한 경우"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <개정 2015.9.1, 2024.2.6>
"Where grounds prescribed by Presidential Decree, such as inflow of harmful substances, appearance of harmful organisms, or deterioration of weather, occur" in the main text of Article 28 (1) of the Act means any of the following cases:
1. 「해양환경관리법」 제2조제2호에 따른 해양오염이 발생하였거나 발생할 우려가 있는 사고가 발생한 경우
1. Where an accident has occurred that has caused or is likely to cause marine pollution under Article 2, subparagraph 2 of the Marine Environment Management Act;
2. 「해양생태계의 보전 및 관리에 관한 법률」 제2조제13호에 따른 유해해양생물(이하 "유해해양생물"이라 한다)이 출현하였거나 출현할 우려가 있는 경우
2. Where harmful marine organisms under Article 2, subparagraph 13 of the Act on the Conservation and Management of Marine Ecosystems (hereinafter referred to as "harmful marine organisms") have appeared or are likely to appear;
3. 유해해양생물 외에 상어 등 사람의 생명에 피해를 줄 수 있는 해양생물이 출현하였거나 출현할 우려가 있는 경우
3. Where marine organisms other than harmful marine organisms that may endanger human life, such as sharks, have appeared or are likely to appear;
4. 「기상법」 제2조제4호에 따른 기상(氣象)현상으로 기상이 악화되고 있거나 악화될 우려가 있는 경우
4. Where weather is deteriorating or is likely to deteriorate owing to meteorological phenomena under Article 2, subparagraph 4 of the Weather Service Act;
5. 기상청장이 「기상법」 제13조의2제1항에 따른 특보 또는 같은 법 제14조제2항에 따른 해양기상특보를 한 경우
5. Where the Administrator of the Korea Meteorological Administration has issued a special weather report under Article 13-2 (1) of the Weather Service Act or a marine weather special report under Article 14 (2) of that Act;
6. 「감염병의 예방 및 관리에 관한 법률」 제2조제1호에 따른 감염병이 발생ㆍ유행하고 있거나 발생ㆍ유행할 우려가 있는 경우
6. Where an infectious disease under Article 2, subparagraph 1 of the Infectious Disease Control and Prevention Act has occurred or is spreading, or is likely to occur or spread;
7. 이안류(離岸流) 등이 발생하고 있거나 발생할 우려가 있는 경우
7. Where rip currents, etc. are occurring or are likely to occur.
