해외건설 촉진법 시행령 제29조의9(운영위원회의 운영)

① 지원공사의 이사 및 감사는 법 제28조의7에 따른 운영위원회(이하 "운영위원회"라 한다)의 회의에 출석하여 의견을 진술할 수 있다.

(1) Directors더^r렉터즈 and앤드 auditors아더터즈 of어^v브 the^ð더 Support서포트 Corporation코퍼^r레이션 may메이 attend어텐드 meetings미팅즈 of어^v브 the^ð더 steering스티^r링 committee커미티 under언더 Article아터클 28-7 of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 the^ð더 "steering스티^r링 committee")커미티 and앤드 state스테잇 their^ð데어 opinions.어피니언즈

② 운영위원회의 회의에 출석한 위원에 대해서는 지원공사의 예산의 범위에서 수당을 지급할 수 있다.

(2) Members멤버즈 attending어텐딩 a어 meeting미팅 of어^v브 the^ð더 steering스티^r링 committee커미티 may메이 be비 paid페이드 allowances얼라원시즈 within위^ð딘 the^ð더 budget버짓 of어^v브 the^ð더 Support서포트 Corporation.코퍼^r레이션

③ 운영위원회의 위원이 다음 각 호의 어느 하나에 해당하는 경우에는 운영위원회의 심의ㆍ의결에서 제척된다.

(3) A어 member멤버 of어^v브 the^ð더 steering스티^r링 committee커미티 shall섈 be비 excluded익스클루디드 from^f프^r럼 deliberation딜리버^r레이션 and앤드 resolution^r레절루션 of어^v브 the^ð더 steering스티^r링 committee커미티 in인 any에니 of어^v브 the^ð더 following^f팔로잉 cases:케이시즈

④ 심의ㆍ의결 안건의 당사자는 운영위원회의 위원에게 제3항에 따른 제척사유가 있거나 공정한 심의ㆍ의결을 기대하기 어려운 사정이 있는 경우에는 운영위원회에 기피 신청을 할 수 있고, 운영위원회는 의결로 기피 여부를 결정한다. 이 경우 기피 신청의 대상인 운영위원회의 위원은 그 의결에 참여하지 못한다.

⑤ 운영위원회의 위원이 제3항 각 호에 따른 제척사유에 해당하는 경우에는 스스로 해당 안건의 심의ㆍ의결에서 회피하여야 한다.

(5) A어 member멤버 of어^v브 the^ð더 steering스티^r링 committee커미티 shall섈 voluntarily^v발런테^r럴리 recuse^r리큐즈 himself힘셀^f프 or오 herself허셀^f프 from^f프^r럼 deliberation딜리버^r레이션 and앤드 resolution^r레절루션 of어^v브 the^ð디 agenda어젠다 item아이텀 if이^f프 he히 or오 she쉬 falls^f폴즈 under언더 any에니 subparagraph서브패^r러그^r래^f프 of어^v브 paragraph패^r러그^r래^f프 (3).

⑥ 운영위원회의 위원의 해촉에 대해서는 제20조의5제1항을 준용한다. 이 경우 "제20조의3제3항제2호에 따른 위원회의 위원"은 "법 제28조의8제1항제5호 및 제6호에 따른 위원"으로, "제20조의4제1항 각 호의 어느 하나"는 "제3항 각 호의 어느 하나"로 본다.

⑦ 제1항부터 제6항까지에서 규정한 사항 외에 운영위원회의 운영에 필요한 세부사항은 운영위원회의 의결을 거쳐 운영위원회의 위원장이 정한다.
