건축법 제77조의13(건축협정에 따른 특례)

① 제77조의4제1항에 따라 건축협정을 체결하여 제59조제1항제1호에 따라 둘 이상의 건축물 벽을 맞벽으로 하여 건축하려는 경우 맞벽으로 건축하려는 자는 공동으로 제11조에 따른 건축허가를 신청할 수 있다.

② 제1항의 경우에 제17조, 제21조, 제22조 및 제25조에 관하여는 개별 건축물마다 적용하지 아니하고 허가를 신청한 건축물 전부 또는 일부를 대상으로 통합하여 적용할 수 있다.

③ 건축협정의 인가를 받은 건축협정구역에서 연접한 대지에 대하여는 다음 각 호의 관계 법령의 규정을 개별 건축물마다 적용하지 아니하고 건축협정구역의 전부 또는 일부를 대상으로 통합하여 적용할 수 있다. <개정 2015.5.18, 2016.1.19>

④ 제3항에 따라 관계 법령의 규정을 적용하려는 경우에는 건축협정구역 전부 또는 일부에 대하여 조경 및 부설주차장에 대한 기준을 이 법 및 「주차장법」에서 정한 기준 이상으로 산정하여 적용하여야 한다.

⑤ 건축협정을 체결하여 둘 이상 건축물의 경계벽을 전체 또는 일부를 공유하여 건축하는 경우에는 제1항부터 제4항까지의 특례를 적용하며, 해당 대지를 하나의 대지로 보아 이 법의 기준을 개별 건축물마다 적용하지 아니하고 허가를 신청한 건축물의 전부 또는 일부를 대상으로 통합하여 적용할 수 있다. <신설 2016.1.19>

⑥ 건축협정구역에 건축하는 건축물에 대하여는 제42조, 제55조, 제56조, 제58조, 제60조 및 제61조와 「주택법」 제35조를 대통령령으로 정하는 바에 따라 완화하여 적용할 수 있다. 다만, 제56조를 완화하여 적용하는 경우에는 제4조에 따른 건축위원회의 심의와 「국토의 계획 및 이용에 관한 법률」 제113조에 따른 지방도시계획위원회의 심의를 통합하여 거쳐야 한다. <신설 2016.2.3>

⑦ 제6항 단서에 따라 통합 심의를 하는 경우 통합 심의의 방법 및 절차 등에 관한 구체적인 사항은 대통령령으로 정한다. <신설 2016.2.3>

⑧ 제6항 본문에 따른 건축협정구역 내의 건축물에 대한 건축기준의 적용에 관하여는 제72조제1항(제2호 및 제4호는 제외한다)부터 제5항까지를 준용한다. 이 경우 "특별건축구역"은 "건축협정구역"으로 본다. <신설 2016.2.3>
