① 조기퇴직수당을 지급받을 수 있는 사람은 경력직공무원(임기제공무원은 제외한다)으로 1년 이상 20년 미만 근속한 사람으로서 직제와 정원의 개정ㆍ폐지 또는 예산의 감소 등으로 직위가 없어지거나 정원이 초과되었을 때에 직위가 없어지거나 정원이 초과된 날부터 3개월 이내에 스스로 퇴직하는 사람으로 한다. <개정 2013.12.11, 2021.1.5>

② 자진퇴직수당을 지급받을 수 있는 사람은 별정직공무원(비서관 및 비서는 제외한다)으로 1년 이상 근속한 사람으로서 직제와 정원의 개정ㆍ폐지 또는 예산의 감소 등으로 직위가 없어지거나 정원이 초과되었을 때에 직위가 없어지거나 정원이 초과된 날부터 3개월 이내에 스스로 퇴직하는 사람으로 한다. <개정 2021.1.5>

③ 제1항에 따른 조기퇴직수당의 금액과 제2항에 따른 자진퇴직수당의 금액은 퇴직 당시 월봉급액의 6개월분에 상응하는 금액으로 한다. 다만, 정년 또는 근무상한 연령까지의 잔여기간이 6개월 미만인 경우에는 그 잔여기간에 상응하는 금액으로 한다.

1. 이 영 또는 다른 법령에 따라 명예퇴직수당 또는 명예퇴직수당 정산금 지급대상인 사람

⑥ 제3조제3항제2호 또는 제3호에 해당하여 이 조 제4항 또는 제5항제3호에 따라 조기퇴직수당 또는 자진퇴직수당 지급대상에서 제외된 사람이 퇴직 후 제3조제3항제2호 또는 제3호와 관련된 사건이 다음 각 호의 어느 하나에 해당하게 된 경우에는 제4항 및 제5항에도 불구하고 조기퇴직수당 또는 자진퇴직수당 지급대상이 될 수 있다. <신설 2025.6.2>
