Enforcement Decree of the Act on the Management and Administration of State-Owned Forests, Article 25 (Criteria for Permission to Transfer Rights and Change Name)

①산림청장은 다음 각 호의 어느 하나에 해당하는 경우에는 법 제25조제2항에 따른 권리양도 또는 명의변경의 허가를 할 수 없다. <개정 2024.7.23>

1. 대부등을 받은 국유림의 일부에 대한 권리만을 양도 또는 명의변경을 하려는 경우. 다만, 법 또는 다른 법령에 따른 사업수행을 위하여 불가피한 경우에는 그러하지 아니하다.

2. 대부계약서 또는 사용허가서에 정한 사항을 위반하여 권리를 양도하거나 명의를 변경하려는 경우

② 법 제25조제2항 각 호 외의 부분에 따라 산림청장의 허가를 받으려는 자는 농림축산식품부령으로 정하는 국유림 권리양도ㆍ명의변경 허가신청서에 농림축산식품부령으로 정하는 서류를 첨부하여 산림청장에게 제출해야 한다. <개정 2024.7.23>
