마약류중독자 치료보호규정 제16조(치료보호기간의 연장)

① 치료보호기관의 장은 마약류중독자가 제13조제1항에 따른 치료보호기간을 넘어 치료보호를 계속하여 받을 필요가 있다고 인정하는 경우에는 그 치료보호기간이 끝나기 1개월 이전에 그 사유 및 연장기간을 별지 제5호서식에 진단서 사본 또는 소견서 사본을 첨부하여 보건복지부장관 또는 시ㆍ도지사에게 보고해야 한다. <개정 2010.3.15, 2022.4.19, 2025.2.6>

② 제1항에 따라 보고를 받은 보건복지부장관 또는 시ㆍ도지사는 해당 위원회의 심의를 거쳐 매회 2개월의 범위에서 마약류중독자의 치료보호기간을 연장할 수 있다. 이 경우 총치료보호기간은 12개월을 넘을 수 없다. <개정 2010.3.15>

③ 제10조제2항 단서에 따라 각 위원회의 심의를 거치기 전에 중독자등을 치료보호한 기간은 제2항 후단에 따른 총치료보호기간에 포함되지 않는다. <개정 2022.4.19>

⑤ 제2항에 따라 마약류중독자의 치료보호기간을 연장한 경우에는 제10조제3항에 따른 통보대상자에게 그 사실을 알려야 한다. <개정 2025.2.6>
