병역법 시행령 제92조(전문연구요원 등의 편입취소자 처리)

① 병역지정업체의 장은 전문연구요원이나 산업기능요원이 법 제41조제1항에 따라 편입이 취소되는 경우에는 복무기록표를 관할 지방병무청장에게 송부하여야 한다. <개정 2016.11.29>

② 관할 지방병무청장은 전문연구요원 및 산업기능요원의 편입이 취소된 사람에 대하여 법 제41조제3항에 따라 병역의무를 부과할 수 있도록 전문연구요원이나 산업기능요원에 편입되기 전의 지방병무청장에게 병적을 이관해야 한다. 이 경우 관할 지방병무청장은 병적기록표에 제3항에 따라 산출된 복무기간을 명시하여 이관해야 한다. <개정 2021.6.22>

③ 전문연구요원 및 산업기능요원이 법 제41조제1항제1호에 따른 부정한 방법으로 법 제38조의2를 위반하여 전직하거나 법 제41조제1항제2호에 따른 부정한 방법으로 전직하여 편입취소된 경우 같은 조 제3항에 따라 현역병으로 입영하게 되거나 사회복무요원으로 소집되어 복무하는 기간은 다음 각 호의 계산방식에 따라 산출된 복무기간으로 한다. 이 경우 소수점 이하의 숫자는 계산하지 않으며, 부정한 방법으로 전직한 이후에 법 제55조제1항에 따른 군사교육을 받은 경우에는 군사교육을 받은 기간은 그 전직 전까지 복무한 일수에 포함하여 산출한다. <개정 2023.12.19>
