Enforcement Decree of the Special Act on the Promotion of Special Research and Development Zones, Article 30 (Regulation, etc. of Building Activities)
① 법 제36조제1항에 따라 법 제35조제1항 및 제2항에 따른 구역에서 건축이 허용되는 건축물의 종류는 별표 1과 같다. 다만, 실시계획, 다른 법령에 따른 개발사업의 실시계획 또는 「국토의 계획 및 이용에 관한 법률」 제49조에 따른 지구단위계획 등 건축이 허용되는 건축물의 종류를 정한 계획이 법 제35조제1항 및 제2항에 따른 구역에 따로 수립되어 있는 경우에는 그 계획에 따른다. <개정 2021.6.22>
(1) The types of buildings permitted to be constructed in the zones under Article 35 (1) and (2) of the Act pursuant to Article 36 (1) of the Act are as set forth in Attached Table 1; provided, that where a plan determining the types of buildings permitted to be constructed, such as an implementation plan, an implementation plan of a development project under other statutes, or a district unit plan under Article 49 of the National Land Planning and Utilization Act, has been separately established for a zone under Article 35 (1) and (2) of the Act, that plan shall apply.
② 제1항 본문에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우로서 과학기술정보통신부장관이 필요하다고 인정하는 경우에는 제33조제2항에 따른 관계 전문가의 심의를 거쳐 별표 1에 따른 규제를 적용하지 아니할 수 있다. <신설 2018.5.8, 2024.5.14>
(2) Notwithstanding the main text of paragraph (1), in any of the following cases, where the Minister of Science and ICT recognizes it as necessary, the regulations under Attached Table 1 need not be applied after deliberation by relevant experts under Article 33 (2):
1. 「국토의 계획 및 이용에 관한 법률」 제43조에 따라 도시ㆍ군계획시설을 설치하는 경우
1. Where Si/Gun planning facilities are installed pursuant to Article 43 of the National Land Planning and Utilization Act;
2. 신산업ㆍ신기술의 육성 등 특구 지정 목적 달성을 위하여 시ㆍ도지사가 요청하는 경우
2. Where requested by the Mayor/Do Governor to achieve the purpose of designating the special zone, such as fostering new industries and new technologies.
