연근해어업의 구조개선 및 지원에 관한 법률 제11조(어선ㆍ어구 감척 대상자 선정)

① 해양수산부장관이나 시ㆍ도지사는 제9조 또는 제10조에 따라 감척 대상 어업으로 지정된 어업을 경영하는 어업자의 신청을 받아 어선ㆍ어구 감척 대상자를 선정하여야 한다. 이 경우 「수산자원관리법」 제20조에 따른 조업척수의 제한으로 조업을 할 수 없거나 외국과의 어업협정 이행의 지연 등으로 상대국 수역에 입어가 제한되거나 금지되는 어선의 어업자가 감척을 희망하는 경우에는 우선적으로 어선ㆍ어구 감척 대상자로 선정하여야 한다. <개정 2013.3.23, 2018.3.13>

② 해양수산부장관이나 시ㆍ도지사는 제1항에도 불구하고 어선ㆍ어구 감척을 신청하는 어업자가 없거나 그 수가 감척시행계획의 목표에 미달하는 경우로서 어업의 경쟁력 제고를 위하여 특별히 필요하다고 인정하면 다음 각 호의 기준을 고려하여 직권으로 어선ㆍ어구 감척 대상자를 선정할 수 있다. 다만, 해양수산부장관이나 시ㆍ도지사가 어업자단체등의 동의를 거쳐 기준을 달리 정할 때에는 그 기준에 따른다. <개정 2013.3.23, 2018.3.13>

③ 해양수산부장관이나 시ㆍ도지사는 제1항 또는 제2항에 따라 어선ㆍ어구 감척 대상자를 선정할 때에는 근해어업의 경우에는 시ㆍ도지사와, 연안어업ㆍ구획어업 및 정치망어업의 경우에는 시장ㆍ군수ㆍ구청장과 협의하여야 한다. 이 경우 제2항에 따라 어선ㆍ어구 감척 대상자를 선정할 때에는 해당 수산조정위원회의 심의를 거쳐야 한다. <개정 2013.3.23, 2016.12.2, 2018.3.13, 2022.1.11>
