의료급여법 제29조의3(위반사실의 공표)

① 보건복지부장관은 관련 서류의 위조ㆍ변조로 의료급여비용을 거짓으로 청구하여 제28조 또는 제29조에 따른 행정처분을 받은 의료급여기관이 다음 각 호의 어느 하나에 해당하는 경우 제2항의 의료급여공표심의위원회의 심의를 거쳐 그 위반 행위, 처분 내용, 해당 의료급여기관의 명칭ㆍ주소 및 대표자 성명, 그 밖에 다른 의료급여기관과의 구별에 필요한 사항으로서 대통령령으로 정하는 사항을 공표할 수 있다. 이 경우 공표 여부를 결정할 때에는 그 위반행위의 동기, 정도, 횟수 및 결과 등을 고려하여야 한다.

② 보건복지부장관은 제1항에 따른 공표 여부 등을 심의하기 위하여 의료급여공표심의위원회(이하 이 조에서 "공표심의위원회"라 한다)를 설치ㆍ운영하여야 한다.

③ 공표심의위원회는 공표 심의 대상자에게 심의 사실 및 내용을 알려 대상자가 소명자료를 제출하거나 출석하여 의견을 진술할 기회를 주어야 하고, 심의과정에서 이를 고려하여야 한다.

④ 그 밖에 공표의 절차ㆍ방법, 공표심의위원회의 구성ㆍ운영 등에 필요한 사항은 대통령령으로 정한다.
