의무경찰대 설치 및 운영에 관한 법률 시행령 제36조의6(부적합한 자의 인사처리)

① 경찰청장 또는 해양경찰청장은 의무경찰이 다음 각 호의 어느 하나에 해당하는 경우에는 국방부장관에게 전환복무 해제를 요청할 수 있다. <개정 2015.11.20, 2016.11.29, 2017.7.26, 2020.11.10>

②국방부장관은 제1항에 따라 전환복무 해제를 요청받은 경우에는 「병역법」 제65조제1항 및 제11항에 따라 처리하고 그 결과를 경찰청장 또는 해양경찰청장에게 통보해야 한다. <개정 1991.7.30, 1994.10.6, 1996.8.8, 1999.3.3, 2005.6.13, 2009.12.7, 2014.11.19, 2015.11.20, 2017.7.26, 2020.11.10>

③ 경찰청장 또는 해양경찰청장은 제1항에 따라 전환복무 해제를 요청한 후 국방부장관으로부터 제2항에 따른 병역처분 변경 통보를 받은 경우에는 병역처분 변경이 통보된 사람을 직권면직 하여야 한다. <개정 2015.11.20, 2017.7.26>
