전기통신사업법 시행령 제47조(과징금의 산정방법 및 절차)

① 법 제52조의3제1항 본문에서 "대통령령으로 정하는 매출액"이란 다음 각 호의 구분에 따른 매출액을 말한다. <신설 2026.4.28>

② 법 제53조제1항 본문 전단에서 "대통령령으로 정하는 매출액"이란 해당 전기통신사업자의 금지행위와 관련된 전기통신역무의 직전 3개 사업연도의 연평균 매출액을 말하고, 법 제53조제2항 각 호 외의 부분에서 "대통령령으로 정하는 매출액"이란 회계 정리 위반과 관련된 전기통신역무의 직전 3개 사업연도의 연평균 매출액을 말한다. <개정 2026.4.28>

③ 제1항 및 제2항에 따라 매출액을 계산할 때에 해당 사업연도 초일 현재 사업을 시작한 지 3년이 되지 않은 경우에는 그 사업 시작 후 직전 사업연도 말일까지의 매출액을 연평균 매출액으로 환산한 금액을 매출액으로 하며, 해당 사업연도에 사업을 시작한 경우에는 사업을 시작한 날부터 위반행위를 한 날까지의 매출액을 연매출액으로 환산한 금액을 매출액으로 한다. <신설 2026.4.28>
