지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제35조(입찰공고의 시기)

① 입찰공고는 그 입찰서 제출 마감일의 전날부터 기산하여 7일 전에 하여야 한다.

② 공사입찰의 경우에는 제1항에도 불구하고 제15조제3항에 따라 현장설명을 하는 경우에는 현장설명일의 전날부터 기산하여 7일 전에 공고하여야 한다. 다만, 제14조에 따른 공사입찰의 경우에는 현장설명일 전날부터 기산하여 30일 전에 공고하여야 한다.

③ 공사입찰의 경우로서 현장설명을 하지 아니할 때에는 제1항 및 제2항에도 불구하고 입찰서 제출 마감일의 전날부터 기산하여 다음 각 호의 어느 하나에 해당하는 기간 전에 공고하여야 한다.

④ 제1항부터 제3항까지의 규정에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 입찰서 제출 마감일의 전날부터 기산하여 5일 전까지 공고할 수 있다. <개정 2016.1.15>

⑤ 제18조에 따른 규격입찰이나 기술입찰, 제43조와 제44조에 따른 협상에 의한 계약 또는 제44조의2에 따른 경쟁적 대화방식에 의한 계약의 경우에는 제1항에도 불구하고 규격ㆍ기술 입찰서 또는 제안서 제출 마감일의 전날부터 기산하여 다음 각 호의 어느 하나에 해당하는 기간 전에 공고하여야 한다. <개정 2014.11.24, 2019.6.25>

⑥ 제5항에도 불구하고 제18조에 따른 규격입찰이나 기술입찰, 제43조와 제44조에 따른 협상에 의한 계약 또는 제44조의2에 따른 경쟁적 대화방식에 의한 계약이 제4항 각 호의 어느 하나에 해당하는 경우에는 제안서 제출 마감일의 전날부터 기산하여 10일 전까지 공고할 수 있다. <개정 2016.1.15, 2019.6.25>
