지방자치단체의 장 또는 법 제5조제3항에 따른 계약담당자(이하 "계약담당자"라 한다)는 예산에 계상(計上)된 금액이나 해당 목적물의 규격서ㆍ설계서 등에 따라 산출된 금액 등을 기준으로 하여 관급자재로 공급될 부분의 가격을 제외하고 추정가격을 산정한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 각 호의 구분에 따른 해당 금액을 추정가격으로 한다.
