지방자치단체의 개방형직위 및 공모직위의 운영 등에 관한 규정 제4조(개방형직위의 충원 시기)

① 임용권자는 제2조에 따라 특정 직위를 개방형직위로 지정하여 최초로 임용하는 경우에는 그 직위에 임명할 수 있는 공무원의 직급(직급의 구분이 없는 경우에는 계급 또는 직급에 상응하는 구분을 말한다. 이하 같다)에 결원이 있거나 결원이 발생하였을 때 법 제29조의4제2항에 따른 직무수행 요건을 갖춘 사람을 지체 없이 임용하여야 한다. 이 경우 둘 이상의 직급으로 임명할 수 있는 개방형직위에 경력직공무원이 임용되어 있는 경우에는 그 직위에 임용되어 있는 공무원의 직급에 결원이 있거나 결원이 발생하였을 때 임용하여야 한다.

② 임용권자는 제5조, 제7조 및 제8조에 따른 절차와 방법에 따라 임용(이하 "개방형임용"이라 한다)된 개방형직위가 다음 각 호의 어느 하나에 해당되는 경우에는 지체 없이 개방형임용을 하여야 한다.

③ 임용권자는 제1항 또는 제2항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에는 그 임용 시기를 조정할 수 있다.
