지방자치법 제142조(예산의 편성 및 의결)

① 지방자치단체의 장은 회계연도마다 예산안을 편성하여 시ㆍ도는 회계연도 시작 50일 전까지, 시ㆍ군 및 자치구는 회계연도 시작 40일 전까지 지방의회에 제출하여야 한다.

② 시ㆍ도의회는 제1항의 예산안을 회계연도 시작 15일 전까지, 시ㆍ군 및 자치구의회는 회계연도 시작 10일 전까지 의결하여야 한다.

③ 지방의회는 지방자치단체의 장의 동의 없이 지출예산 각 항의 금액을 증가시키거나 새로운 비용항목을 설치할 수 없다.

④ 지방자치단체의 장은 제1항의 예산안을 제출한 후 부득이한 사유로 그 내용의 일부를 수정하려면 수정예산안을 작성하여 지방의회에 다시 제출할 수 있다.
