초ㆍ중등교육법 시행령 제44조(학기)

①법 제24조제4항에 따른 학교의 학기는 매학년도를 두 학기로 나누되, 제1학기는 3월 1일부터 학교의 수업일수ㆍ휴업일 및 교육과정 운영을 고려하여 학교의 장이 정한 날까지, 제2학기는 제1학기 종료일 다음 날부터 다음 해 2월말일까지로 한다. <개정 2004.2.17, 2010.6.29, 2026.4.14>

② 제1항에도 불구하고 제91조의4에 따른 자율형 사립고등학교, 제91조의5에 따른 자율형 공립고등학교 및 제105조에 따른 자율학교(이하 "자율학교등"이라 한다)의 장은 교육부장관이 정하는 바에 따라 제105조의4에 따른 자율학교등 지정ㆍ운영위원회의 심의를 거쳐 학기를 달리 정할 수 있다. <신설 2010.6.29, 2013.2.15, 2013.3.23, 2020.2.28, 2024.1.23, 2026.5.26>

③ 중학교 및 특수학교(중학교의 과정을 교육하는 특수학교로 한정한다)의 장은 제1항에 따른 학기(특수학교의 경우에는 중학교의 과정을 교육하는 학기로 한정한다) 중 한 학기 또는 두 학기를 자유학기로 지정해야 한다. 이 경우 지정 대상 학기의 범위 등 자유학기의 지정에 관한 세부 사항은 교육부장관이 정한다. <신설 2015.9.15, 2017.11.28, 2020.2.25>
