공무원수당 등에 관한 규정 제11조(자녀학비보조수당)

① 다음 각 호의 어느 하나의 학교 또는 시설(이하 "국외학교"라 한다)에 다니고 있는 자녀가 있는 재외공무원에게는 예산의 범위에서 자녀 1명당 별표 6의 지급 구분에 따라 자녀학비보조수당을 지급한다. 다만, 자녀가 법령에 따라 학비가 면제되거나 학비가 무상인 국외학교에 다니고 있는 경우에는 자녀학비보조수당을 지급하지 않는다. <개정 2021.1.5>

② 재외공무원은 제1항에 따른 자녀학비보조수당을 지급받으려는 경우 그 지급 사유가 최초로 발생하였을 때 자녀학비보조수당 지급 신청서에 해당 자녀의 공납금 납입영수증이나 공납금 납입고지서(부득이한 경우에는 자녀학비보조수당 신청용이라는 용도가 명시된 재학증명서)를 첨부하여 소속 장관에게 제출해야 한다. 이 경우 소속 장관은 신청서를 접수한 날부터 15일 이내에 자녀학비보조수당을 지급해야 한다. <개정 2021.1.5>

③ 자녀학비보조수당을 지급받고 있는 재외공무원은 퇴학ㆍ휴학ㆍ복학ㆍ전학 등 해당 자녀의 취학사항에 변동이 있는 경우에는 소속 장관에게 그 사실을 입증할 수 있는 서류를 제출하여 변동신고를 해야 한다. <개정 2021.1.5>

④ 자녀학비보조수당은 제2항 및 제3항에 따른 신청ㆍ신고를 해야 지급받을 수 있으며, 그 지급액은 지급 사유가 발생한 날이 속하는 달부터 월할 계산하여 지급하되, 그 기간 중에 수당을 지급받을 자격이 상실되는 경우에는 지급한 수당액을 월 단위로 계산하여 환수한다. 이 경우 봉급 지급일수 15일 이상은 1개월로 계산하고, 15일 미만은 계산하지 않는다. <개정 2021.1.5>

⑤ 제4항에도 불구하고 공무원 신분이 계속되는 경우로서 학비를 이미 낸 후 해당 취학 자녀가 사망 또는 퇴학하거나 그 밖의 사유로 학업을 중단한 경우에는 지급한 수당을 환수하지 않는다. <신설 2021.1.5>

⑥ 강등ㆍ정직ㆍ감봉ㆍ직위해제 및 휴직으로 봉급이 감액 지급되는 공무원에게는 별표 4의 구분에 따라 자녀학비보조수당을 감액 지급하되, 제4항에 따라 월할 계산하여 지급한다. <개정 2009.3.31, 2021.1.5>

⑦ 자녀학비보조수당에 관하여는 제10조제4항ㆍ제5항ㆍ제10항 및 제11항을 준용한다. <개정 2010.1.7, 2021.1.5>

⑧ 소속 장관은 자녀학비보조수당을 지급받을 자격을 확인하기 위하여 필요한 경우에는 해당 재외공무원에게 주민등록표 등본ㆍ초본 또는 가족관계증명서를 제출하게 할 수 있다. <신설 2021.1.5>
