국가유공자 등 예우 및 지원에 관한 법률 시행령 제24조(협의에 의한 보상금 수급자의 지정 방법 및 효력)

① 법 제13조제2항제1호에 따라 유족 간의 협의에 의하여 보상금을 지급받으려는 사람은 같은 순위인 유족 모두의 협의를 거쳐 국가보훈부령으로 정하는 보상금수급자 지정서에 같은 순위 유족 모두의 인감증명서(같은 순위 유족이 미성년자인 경우에는 그 법정대리인의 인감증명서를 말한다)를 첨부하여 국가보훈부장관에게 제출해야 한다. 다만, 외국에 거주 중인 같은 순위 유족이 있는 등 보상금수급자 지정서를 제출할 수 없는 부득이한 사정이 있는 경우에는 보상금수급자로 지정한 사실을 나타내는 「공증인법」에 따른 공정증서를 제출하는 것으로 보상금수급자 지정서의 제출을 갈음할 수 있다. <개정 2012.6.27, 2019.12.24, 2023.5.23>

② 법 제13조제2항제1호에 따른 협의의 효력은 협의 당사자 일방의 의사에 의하여 변경되지 않는다. 다만, 국가유공자의 부모가 협의에 의하여 부모 중 1명을 보상금을 받을 사람으로 정했더라도 부모 중 1명이 법 제13조제2항제3호에 따른 보상금 분할 지급을 신청한 경우에는 그 보상금 수급자 지정 협의의 효력은 상실된다. <신설 2019.12.24>
