기초연금법 제11조(조사ㆍ질문 등)

① 보건복지부장관 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 기초연금 수급권의 발생ㆍ변경ㆍ상실 등을 확인하기 위하여 기초연금을 신청한 기초연금 수급희망자, 기초연금 수급권자, 기초연금 수급자와 그 각각의 배우자 및 고용주(이하 이 조에서 "기초연금 수급권자등"이라 한다)에게 필요한 서류나 그 밖에 소득ㆍ재산 등에 관한 자료의 제출을 요구할 수 있으며, 소속 공무원으로 하여금 기초연금 수급권자등의 집이나 그 밖의 필요한 장소에 방문하여 서류 등을 조사하게 하거나 관계인에게 필요한 질문을 하게 할 수 있다. <개정 2016.2.3>

② 보건복지부장관 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 확인ㆍ조사 또는 기초연금사업의 수행을 위하여 기초연금 수급권자등의 다음 각 호에 해당하는 자료 또는 정보의 제공을 관계 기관의 장에게 요청할 수 있다. 이 경우 자료 또는 정보의 제공을 요청받은 관계 기관의 장은 특별한 사유가 없으면 그 요청에 따라야 한다. <개정 2016.12.27, 2018.3.20, 2019.8.27>

③ 제1항에 따라 방문ㆍ조사ㆍ질문을 하는 관계 공무원은 그 권한을 표시하는 증표 및 조사기간, 조사범위, 조사담당자, 관계 법령 등 보건복지부령으로 정하는 사항이 기재된 서류를 지니고 이를 관계인에게 보여 주어야 한다. <개정 2016.2.3>

④ 보건복지부장관 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 기초연금 수급희망자, 기초연금 수급권자 또는 기초연금 수급자가 제1항에 따른 서류 또는 자료를 제출하지 아니하거나 거짓의 서류 또는 자료를 제출한 경우 또는 조사ㆍ질문을 거부ㆍ방해 또는 기피하거나 거짓 답변을 한 경우에는 기초연금 지급의 신청을 각하하거나 기초연금 지급의 결정을 취소하거나 기초연금 지급을 정지할 수 있다.

⑤ 제2항에 따라 자료 또는 정보를 제공받은 경우에는 해당 법령에 따라 부과되는 수수료 또는 사용료 등을 면제한다.

⑥ 제1항에 따른 조사ㆍ질문의 범위ㆍ시기ㆍ내용ㆍ절차ㆍ방법 등에 관하여는 이 법에서 정하는 사항을 제외하고는 「행정조사기본법」에서 정하는 바를 따르며, 그 밖에 필요한 사항은 대통령령으로 정한다. <개정 2016.2.3>
