부동산등기법 제87조(신탁등기의 말소)

① 신탁재산에 속한 권리가 이전, 변경 또는 소멸됨에 따라 신탁재산에 속하지 아니하게 된 경우 신탁등기의 말소신청은 신탁된 권리의 이전등기, 변경등기 또는 말소등기의 신청과 동시에 하여야 한다.

② 신탁종료로 인하여 신탁재산에 속한 권리가 이전 또는 소멸된 경우에는 제1항을 준용한다.

③ 신탁등기의 말소등기는 수탁자가 단독으로 신청할 수 있다.

④ 신탁등기의 말소등기의 신청에 관하여는 제82조제2항 및 제3항을 준용한다.
