Enforcement Decree of the Aquatic Life Disease Control Act, Article 19 (Delegation and Entrustment of Authority)
① 해양수산부장관은 법 제52조제1항에 따라 다음 각 호의 권한을 국립수산과학원장에게 위임한다. <개정 2021.2.9>
(1) Pursuant to Article 52 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority to the President of the National Institute of Fisheries Science:
1. 법 제5조제1항에 따른 종합계획의 수립 및 시행
1. Formulation and implementation of the comprehensive plan under Article 5 (1) of the Act;
2. 법 제39조제1항에 따른 수산생물질병의 예방에 관한 기술의 시험ㆍ분석
2. Testing and analysis of technology for prevention of aquatic life diseases under Article 39 (1) of the Act.
② 해양수산부장관은 법 제52조제1항에 따라 다음 각 호의 권한을 국립수산물품질관리원장에게 위임한다. <개정 2021.2.9, 2022.4.27, 2023.2.24, 2024.6.11>
(2) Pursuant to Article 52 (1) of the Act, the Minister of Oceans and Fisheries delegates the following authority to the Commissioner of the National Fishery Products Quality Management Service:
1. 법 제5조의2제1항에 따른 국가수산생물방역통합정보시스템의 구축ㆍ운영
1. Establishment and operation of the national integrated aquatic life disease control information system under Article 5-2 (1) of the Act;
2. 법 제6조의2제1항에 따른 수산생물질병에 관한 정보의 공개
2. Disclosure of information on aquatic life diseases under Article 6-2 (1) of the Act;
3. 법 제7조제1항에 따른 수산생물방역관의 임명
3. Appointment of aquatic life quarantine officers under Article 7 (1) of the Act;
4. 법 제7조제2항 및 법 제8조제1항에 따른 수산생물방역에 관한 교육
4. Education on aquatic life disease control under Article 7 (2) and Article 8 (1) of the Act;

9-2. The following authority under Article 21-2 of the Act:
가. 법 제21조의2제1항에 따른 수출수산생물을 양식ㆍ가공 또는 보관하는 시설의 등록
(a) Registration of facilities that farm, process, or store export aquatic life under Article 21-2 (1) of the Act;
나. 법 제21조의2제3항에 따른 수출수산생물질병관리기준 준수 여부의 확인ㆍ점검
(b) Verification and inspection of compliance with export aquatic life disease control standards under Article 21-2 (3) of the Act;
다. 법 제21조의2제4항에 따른 수출수산생물질병관리기준의 준수 사실 증명서류의 발급
(c) Issuance of documents certifying compliance with export aquatic life disease control standards under Article 21-2 (4) of the Act;
라. 법 제21조의2제5항 각 호에 따른 조치
(d) Measures under the subparagraphs of Article 21-2 (5) of the Act;
10. 법 제24조제1항 단서에 따른 시험ㆍ연구조사 또는 수산생물질병의 진료와 예방을 위한 의약품의 제조에 사용하기 위하여 수입하는 수산생물이나 물건의 수입허가
10. Permission for import of aquatic life or objects imported for use in testing, research, and investigation, or in manufacturing medicines for the treatment and prevention of aquatic life diseases, under the proviso of Article 24 (1) of the Act;
10의2. 법 제25조의2에 따른 다음 각 목의 권한
10-2. The following authority under Article 25-2 of the Act:
가. 법 제25조의2제1항 및 제2항에 따른 지정검역물 양식ㆍ가공 또는 보관시설에 관한 사항의 등록 및 변경등록
(a) Registration and change of registration of matters concerning farming, processing, or storage facilities for designated quarantine items under Article 25-2 (1) and (2) of the Act;
나. 법 제25조의2제3항에 따른 자료의 요청
(b) Requests for data under Article 25-2 (3) of the Act;
다. 법 제25조의2제4항에 따른 등록 또는 변경등록의 취소
(c) Revocation of registration or change of registration under Article 25-2 (4) of the Act;
라. 법 제25조의2제5항에 따른 수입검역의 거부
(d) Refusal of import quarantine under Article 25-2 (5) of the Act;
10의3. 법 제25조의3제1항 및 제5항에 따른 현지실사 및 비대면 조사
10-3. On-site inspections and non-face-to-face investigations under Article 25-3 (1) and (5) of the Act;
11. 법 제28조에 따른 파견검역
11. Dispatched quarantine under Article 28 of the Act;
12. 법 제35조에 따른 재검역
12. Re-quarantine under Article 35 of the Act;
13. 법 제36조에 따른 검역판정의 취소 및 재검역

19. 법 제57조제2항제1호에 따른 과태료의 부과ㆍ징수

③ 시ㆍ도지사는 법 제52조제1항에 따라 법 제48조제1항에 따른 명예수산생물방역감시원의 위촉 권한을 시장ㆍ군수ㆍ구청장에게 위임한다. <개정 2012.7.20>
(3) Pursuant to Article 52 (1) of the Act, the Mayor/Do Governor delegates the authority to commission honorary aquatic life disease control inspectors under Article 48 (1) of the Act to the head of a Si/Gun/Gu.
④ 해양수산부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 법 제52조제2항에 따라 법 제7조제4항에 따른 시료채취에 관한 업무, 법 제38조제1항에 따른 방역교육에 관한 업무를 해양수산부장관이 정하여 고시하는 「수산업협동조합법」에 따른 수산업협동조합중앙회, 「민법」 제32조에 따라 설립된 대한수산질병관리사회 또는 「수의사법」 제23조에 따라 설립된 대한수의사회에 위탁한다. <개정 2013.3.23, 2018.5.28>
(4) Pursuant to Article 52 (2) of the Act, the Minister of Oceans and Fisheries, the Mayor/Do Governor, or the head of a Si/Gun/Gu entrusts duties relating to sampling under Article 7 (4) of the Act and duties relating to disease control education under Article 38 (1) of the Act to the National Federation of Fisheries Cooperatives under the Fisheries Cooperatives Act, the Korean Association of Aquatic Disease Control Specialists established under Article 32 of the Civil Act, or the Korean Veterinary Medical Association established under Article 23 of the Veterinary Practice Act, as prescribed and publicly notified by the Minister of Oceans and Fisheries.
⑤ 해양수산부장관은 법 제52조제3항에 따라 다음 각 호의 구분에 따른 업무를 해당 법인 또는 단체에 각각 위탁한다. <개정 2018.5.28>
(5) Pursuant to Article 52 (3) of the Act, the Minister of Oceans and Fisheries entrusts the following duties to the relevant corporation or organization, according to the following classification:
1. 법 제21조에 따른 질병관리등급의 부여ㆍ관리에 관한 업무: 해양수산부장관이 정하여 고시하는 「민법」 제32조에 따라 설립된 대한수산질병관리사회 또는 「수의사법」 제23조에 따라 설립된 대한수의사회
1. Duties relating to the grading and management of disease control grades under Article 21 of the Act: The Korean Association of Aquatic Disease Control Specialists established under Article 32 of the Civil Act or the Korean Veterinary Medical Association established under Article 23 of the Veterinary Practice Act, as prescribed and publicly notified by the Minister of Oceans and Fisheries;
2. 법 제37조의18에 따른 수산질병관리사의 연수교육에 관한 업무: 「민법」 제32조에 따라 설립된 대한수산질병관리사회
2. Duties relating to continuing education for aquatic disease control specialists under Article 37-18 of the Act: The Korean Association of Aquatic Disease Control Specialists established under Article 32 of the Civil Act.
⑥ 국립수산과학원장 및 국립수산물품질관리원장은 제1항 및 제2항에 따라 위임받은 권한의 일부를 「정부조직법」 제6조제1항 후단에 따라 소속 기관의 장에게 재위임한 때에는 그 내용을 고시하여야 한다. <개정 2011.6.7, 2013.3.23>
(6) Where the President of the National Institute of Fisheries Science or the Commissioner of the National Fishery Products Quality Management Service has redelegated part of the authority delegated under paragraphs (1) and (2) to the head of an affiliated institution pursuant to the latter part of Article 6 (1) of the Government Organization Act, he or she shall publicly notify the details thereof.
