전기사업법 시행령 제62조의3(고유식별정보의 처리)
Enforcement Decree of the Electric Utility Act, Article 62-3 (Processing of Unique Identification Information)
① 기후에너지환경부장관(법 제98조제1항에 따라 기후에너지환경부장관의 권한을 위임받은 자를 포함한다)은 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다. <개정 2024.4.30, 2025.10.1>
(1) Where unavoidable to perform the following affairs, the Minister of Climate, Energy and Environment (including a person to whom the authority of the Minister has been delegated under Article 98 (1) of the Act) may process data containing resident registration numbers or foreigner registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제7조제1항에 따른 전기사업의 허가 및 변경허가에 관한 사무
1. Affairs concerning permission and modification permission of electricity business under Article 7 (1) of the Act;
2. 법 제8조에 따른 전기사업 허가 신청자의 결격사유 확인에 관한 사무
2. Affairs concerning confirmation of grounds for disqualification of applicants for electricity business permits under Article 8 of the Act;
3. 법 제10조에 따른 전기사업의 양수 및 전기사업자인 법인의 분할 또는 합병의 인가에 관한 사무
3. Affairs concerning approval of the transfer of electricity business and the division or merger of a corporation that is an electricity business operator under Article 10 of the Act;
4. 법 제11조제1항 및 제2항에 따른 사업의 승계에 관한 사무
4. Affairs concerning succession to business under Article 11 (1) and (2) of the Act;
5. 법 제12조제4항 및 제6항에 따른 과징금의 부과 및 징수에 관한 사무
5. Affairs concerning the imposition and collection of penalty surcharges under Article 12 (4) and (6) of the Act; and
6. 법 제108조에 따른 과태료의 부과 및 징수에 관한 사무
6. Affairs concerning the imposition and collection of administrative fines under Article 108 of the Act.
② 송전사업자 또는 배전사업자는 법 제15조에 따라 인가받은 이용요금에 따른 송전ㆍ배전용 전기설비 이용자 부담 비용 등의 부과ㆍ징수에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(2) Where unavoidable to perform affairs concerning the imposition and collection of costs borne by users of electrical facilities for transmission or distribution under usage fees approved under Article 15 of the Act, a transmission business operator or distribution business operator may process data containing resident registration numbers or foreigner registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act.
③ 전기판매사업자는 법 제16조에 따른 약관에 따른 전기공급 및 전기요금의 부과 및 징수에 관한 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(3) Where unavoidable to perform affairs concerning electricity supply and the imposition and collection of electricity charges under the terms and conditions under Article 16 of the Act, an electricity retail business operator may process data containing resident registration numbers or foreigner registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act.

⑤ 전기사업자는 다음 각 호의 사무를 수행하기 위하여 불가피한 경우 「개인정보 보호법 시행령」 제19조제1호 또는 제4호에 따른 주민등록번호 또는 외국인등록번호가 포함된 자료를 처리할 수 있다.
(5) Where unavoidable to perform the following affairs, an electricity business operator may process data containing resident registration numbers or foreigner registration numbers under Article 19, subparagraph 1 or 4 of the Enforcement Decree of the Personal Information Protection Act:
1. 법 제72조에 따른 설비의 이설 관련 비용 부담에 관한 사무
1. Affairs concerning bearing of costs related to relocation of facilities under Article 72 of the Act;
2. 법 제72조의2에 따른 가공전선로의 지중이설 관련 비용 부담에 관한 사무
2. Affairs concerning bearing of costs related to underground relocation of overhead power lines under Article 72-2 of the Act; and
3. 법 제87조부터 제89조까지의 규정에 따른 토지 등의 사용 또는 출입에 관한 사무
3. Affairs concerning use of or entry into land, etc. under Articles 87 through 89 of the Act.
