전남광주통합특별시 설치를 위한 특별법 제196조(산업단지 내 환경기초시설 설치에 관한 특례)

① 통합특별시장 또는 산업단지 소재지 시장ㆍ군수ㆍ구청장은 환경기초시설 구축을 위하여 산업단지(국가산업단지 등을 말한다) 안의 부지에 「폐기물관리법」 제2조제8호에 따른 폐기물처리시설을 설치ㆍ운영할 수 있다. 이 경우 「산업입지 및 개발에 관한 법률」, 「산업집적활성화 및 공장설립에 관한 법률」에 따른 산업단지관리기본계획, 입주업종 제한 및 그 밖의 관계 규정에도 불구하고 해당 환경기초시설을 산업단지 기반시설로 본다.

② 통합특별시장 또는 산업단지 소재지 시장ㆍ군수ㆍ구청장은 제1항에 따른 폐기물처리시설의 설치ㆍ운영을 위하여 필요한 경우 산업단지 지정권자ㆍ관리권자와 협의하여 관리기본계획 또는 개발계획의 변경 등 필요한 조치를 할 수 있고, 관계 기관은 특별한 사유가 없으면 이에 협조하여야 한다.
