Enforcement Decree of the Electric Power Technology Management Act, Article 18 (Design Supervision, etc.)
① 법 제11조제4항에서 "대통령령으로 정하는 요건에 해당하는 전력시설물"이란 다음 각 호의 어느 하나에 해당하는 전력시설물을 말한다. <개정 2013.3.23, 2016.7.26, 2016.8.11, 2025.10.1>
(1) The "electric power facilities meeting the requirements prescribed by Presidential Decree" in Article 11 (4) of the Act means electric power facilities falling under any of the following:
1. 용량 80만킬로와트 이상의 발전설비
1. Power generation facilities with a capacity of 800,000 kilowatts or more;
2. 전압 30만볼트 이상의 송전ㆍ변전설비
2. Power transmission and substation facilities with a voltage of 300,000 volts or more;
3. 전압 10만볼트 이상의 수전설비ㆍ구내배전설비ㆍ전력사용설비
3. Power receiving facilities, on-premises power distribution facilities and power-consuming facilities with a voltage of 100,000 volts or more;
4. 전기철도의 수전설비ㆍ철도신호설비ㆍ구내배전설비ㆍ전차선설비ㆍ전력사용설비
4. Power receiving facilities, railway signal facilities, on-premises power distribution facilities, overhead contact line facilities and power-consuming facilities of electric railways;
5. 국제공항의 수전설비ㆍ구내배전설비ㆍ전력사용설비
5. Power receiving facilities, on-premises power distribution facilities and power-consuming facilities of international airports;
6. 21층 이상이거나 연면적 5만제곱미터 이상인 건축물의 전력시설물. 다만, 「주택법」 제2조제3호에 따른 공동주택의 전력시설물은 제외한다.
6. Electric power facilities of buildings with 21 or more floors or a total floor area of 50,000 square meters or more: Provided, That electric power facilities of multi-family housing under subparagraph 3 of Article 2 of the Housing Act are excluded;
7. 그 밖에 기후에너지환경부령으로 정하는 전력시설물
7. Other electric power facilities prescribed by Ordinance of the Ministry of Climate, Energy and Environment.
② 법 제11조제4항에 따른 설계도서의 설계감리는 제27조제1항에 따라 종합설계업 등록을 한 자 또는 기후에너지환경부령으로 정하는 기준에 해당하는 설계감리자로서 특별시장ㆍ광역시장ㆍ특별자치시장ㆍ도지사 또는 특별자치도지사(이하 "시ㆍ도지사"라 한다)의 확인을 받은 자가 수행한다. 이 경우 설계감리 업무에 참여할 수 있는 사람은 전기 분야 기술사, 고급기술자 또는 고급감리원(경력수첩 또는 감리원 수첩을 발급받은 사람을 말한다. 이하 이 조에서 같다) 이상인 사람으로 한다. <개정 2010.9.20, 2011.4.6, 2013.3.23, 2016.7.26, 2025.10.1>
(2) Design supervision of design documents under Article 11 (4) of the Act shall be performed by a person who has registered a comprehensive design business under Article 27 (1), or a design supervisor meeting the standards prescribed by Ordinance of the Ministry of Climate, Energy and Environment who has been verified by the Mayor of a Special Metropolitan City, Metropolitan City or Special Self-Governing City, a Do Governor or the Special Self-Governing Province Governor (hereinafter referred to as a "Mayor/Do Governor"). In such cases, persons who may participate in design supervision duties shall be professional engineers in the electrical field, senior engineers or senior supervisors (meaning persons issued a career book or supervisor's handbook; the same applies in this Article) or higher.
③ 설계감리를 받으려는 자는 해당 설계도서를 작성한 자를 설계감리자로 선정하여서는 아니 된다.
(3) A person who intends to receive design supervision shall not select the person who prepared the relevant design documents as the design supervisor.
④ 제2항 전단에도 불구하고 다음 각 호의 어느 하나에 해당하는 자가 설치하거나 보수하는 전력시설물의 설계도서는 그 소속의 전기 분야 기술사, 고급기술자 또는 고급감리원 이상인 사람이 그 설계감리를 할 수 있다. <개정 2009.12.24, 2010.9.20, 2011.4.6, 2012.1.25, 2020.9.10>
(4) Notwithstanding the first sentence of paragraph (2), design documents of electric power facilities installed or repaired by any of the following persons may be design-supervised by a professional engineer in the electrical field, senior engineer or senior supervisor, or higher, belonging to that person:
1. 국가 및 지방자치단체
1. The State and local governments;
2. 「공공기관의 운영에 관한 법률」 제5조에 따른 공기업(이하 "공기업"이라 한다)
2. A public enterprise under Article 5 of the Act on the Management of Public Institutions (hereinafter referred to as a "public enterprise");
3. 「지방공기업법」에 따른 지방공사 및 지방공단
3. A local public corporation and local public corporate body under the Local Public Enterprises Act;
4. 「국가철도공단법」에 따른 국가철도공단
4. The Korea Rail Network Authority under the Korea Rail Network Authority Act;
5. 「한국환경공단법」에 따른 한국환경공단
5. The Korea Environment Corporation under the Korea Environment Corporation Act;

7. 「한국농수산식품유통공사법」에 따른 한국농수산식품유통공사
7. The Korea Agro-Fisheries and Food Trade Corporation under the Korea Agro-Fisheries and Food Trade Corporation Act;
8. 「한국농어촌공사 및 농지관리기금법」에 따른 한국농어촌공사
8. The Korea Rural Community Corporation under the Korea Rural Community Corporation and Farmland Management Fund Act;
9. 「대한무역투자진흥공사법」에 따른 대한무역투자진흥공사
9. The Korea Trade-Investment Promotion Agency under the Korea Trade-Investment Promotion Agency Act;
10. 「전기사업법」에 따른 전기사업자
10. An electric utility operator under the Electric Utility Act.
⑤ 법 제11조제4항에 따른 설계감리의 업무 범위는 다음 각 호와 같다.
(5) The scope of duties of design supervision under Article 11 (4) of the Act is as follows:
1. 전력시설물공사의 관련 법령, 기술기준, 설계기준 및 시공기준에의 적합성 검토
1. Review of conformity of electric power facility works with relevant statutes, technical standards, design standards and construction standards;
2. 사용자재의 적정성 검토
2. Review of the appropriateness of materials used;
3. 설계내용의 시공 가능성에 대한 사전 검토
3. Advance review of the constructability of the design;
4. 설계공정의 관리에 관한 검토
4. Review of management of the design process;
5. 공사기간 및 공사비의 적정성 검토
5. Review of the appropriateness of the construction period and construction costs;
6. 설계의 경제성 검토
6. Review of the economic feasibility of the design;
7. 설계도면 및 설계설명서 작성의 적정성 검토
7. Review of the appropriateness of preparation of design drawings and design specifications.
⑥ 기후에너지환경부장관은 설계감리업무를 효율적으로 수행하기 위하여 그 업무 수행에 관한 세부기준을 정하여 고시한다. <개정 2013.3.23, 2025.10.1>
(6) The Minister of Climate, Energy and Environment shall determine and publicly notify detailed standards on the performance of design supervision duties in order to perform them efficiently.
