Enforcement Decree of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City, Article 49 (Special Provisions on the Operation of International High Schools, etc.)

① 국제고등학교의 장은 법 제217조제2항 및 제5항에 따라 국제고등학교 운영에 관하여 다음 각 호의 사항을 달리 정할 수 있다.

1. 「초ㆍ중등교육법」 제23조제2항ㆍ제3항 및 같은 법 시행령 제43조제1항제3호에 따른 교육과정과 교과. 다만, 고등학교 교육과정의 국어 교과와 사회 교과(한국사를 포함한다)는 제외한다.

2. 「초ㆍ중등교육법」 제24조제1항에 따른 학년도

3. 「초ㆍ중등교육법」 제24조제3항과 같은 법 시행령 제44조ㆍ제45조에 따른 학기와 수업일수. 다만, 수업일수를 줄이는 경우 그 단축 수업일수는 같은 법 시행령 제45조에 따른 수업일수의 100분의 20 이내로 한다.

4. 「초ㆍ중등교육법」 제26조에 따른 학년제

5. 「초ㆍ중등교육법」 제31조와 같은 법 시행령 제58조ㆍ제63조에 따른 학교운영위원회 위원의 정수와 구성비율. 다만, 위원의 정수와 구성비율을 달리하는 경우 그 조정 범위는 각각 같은 조에 따른 위원의 정수와 구성비율의 100분의 20을 초과해서는 아니 된다.

6. 「초ㆍ중등교육법」 제46조에 따른 수업연한. 다만, 수업연한을 줄이는 경우 그 단축 수업연한은 같은 조에 따른 수업연한의 1년 이내로 한다.

② 교육부장관은 법 제217조제2항 및 제5항에 따라 국제고등학교에 대하여 「초ㆍ중등교육법」 제9조제2항에 따른 학교평가를 실시하는 경우에는 같은 법 시행령 제12조와 제13조에도 불구하고 국제고등학교의 특성이 반영될 수 있도록 평가 기준ㆍ절차 등을 달리 정할 수 있다.

③ 국제고등학교에는 법 제217조제2항 및 제5항에 따라 「초ㆍ중등교육법」 제19조제4항에 따른 교원의 배치기준에도 불구하고 그 기준 이상으로 교원을 배치할 수 있다. 이 경우 초과 배치하는 교원은 특별한 사정이 없으면 외국어를 사용하여 수업할 수 있는 능력이 있는 사람을 우선 배치하여야 한다.

④ 국제고등학교에는 법 제217조제2항 및 제5항에 따라 「초ㆍ중등교육법」 제19조의2제1항에 따른 전문상담교사를 배치할 수 있다. 이 경우 전문상담교사의 배치기준은 도교육감이 정한다.

⑤ 국제고등학교에는 법 제217조제2항 및 제5항에 따라 「초ㆍ중등교육법」 제21조제1항 및 제2항에 따른 교장 자격, 교감 자격 및 교사 자격이 없는 사람을 교장, 교감 또는 교사로 임용할 수 있다. 다만, 교원(기간제교원을 포함한다) 자격이 없는 사람이 전체 재직 교원수의 2분의 1을 초과해서는 아니 된다.

⑥ 법 제217조제3항 및 제5항에 따라 외국인의 입학 자격과 방법 등에 관하여 필요한 사항은 국제고등학교의 장이 정한다. 이 경우 외국인의 국적 등을 이유로 입학(재입학ㆍ전학ㆍ편입학을 포함한다)을 차별해서는 아니 된다.

⑦ 국제고등학교에는 법 제217조제4항에 따라 다음 각 호의 어느 하나에 해당하는 외국인을 기간제교원으로 임용할 수 있다. 다만, 제3호에 해당하는 사람은 외국어 교과에만 임용할 수 있다.

⑧ 제7항에 따른 외국인 기간제교원의 임용과 보수 등에 관하여 필요한 사항은 도조례로 정한다.

⑨ 법 제217조제2항ㆍ제5항 및 제6항에 따른 국제고등학교의 교과용 도서의 사용, 교원의 임용 요청, 특별수당 등에 관하여는 각각 제46조제6항부터 제9항까지의 규정을 준용한다. 이 경우 "자율학교"는 "국제고등학교"로 본다. <개정 2025.11.25>
