Fair Transactions in Franchise Business Act, Article 41 (Penalty Provisions)

①제9조제1항의 규정에 위반하여 허위ㆍ과장의 정보제공행위나 기만적인 정보제공행위를 한 자는 5년 이하의 징역 또는 3억원 이하의 벌금에 처한다. <개정 2007.8.3, 2013.8.13>

②다음 각 호의 어느 하나에 해당하는 자는 3년 이하의 징역 또는 1억원 이하의 벌금에 처한다. <개정 2007.8.3, 2018.1.16, 2020.12.29, 2025.12.30>

1. 제12조의5(제15조의6에서 준용하는 경우를 포함한다)를 위반하여 가맹점사업자(제15조의6에서 준용하는 제12조의5를 위반하는 경우에는 가맹지역본부를 말한다)에게 불이익을 주는 행위를 하거나 다른 사업자로 하여금 이를 행하도록 한 자

1. 제6조의5제1항을 위반하여 가맹점사업자로부터 예치가맹금을 직접 수령한 자
