민사집행법 제140조(공유자의 우선매수권)

①공유자는 매각기일까지 제113조에 따른 보증을 제공하고 최고매수신고가격과 같은 가격으로 채무자의 지분을 우선매수하겠다는 신고를 할 수 있다.

②제1항의 경우에 법원은 최고가매수신고가 있더라도 그 공유자에게 매각을 허가하여야 한다.

③여러 사람의 공유자가 우선매수하겠다는 신고를 하고 제2항의 절차를 마친 때에는 특별한 협의가 없으면 공유지분의 비율에 따라 채무자의 지분을 매수하게 한다.

④제1항의 규정에 따라 공유자가 우선매수신고를 한 경우에는 최고가매수신고인을 제114조의 차순위매수신고인으로 본다.
