상표법 제82조(상표권의 설정등록)

Trademark Act, Article 82 (Establishment Registration of Trademark Rights)

① 상표권은 설정등록에 의하여 발생한다.

(1) A어 trademark트^r레이드마크 right^r라잇 shall섈 come컴 into인투 existence에그지스튼스 upon어판 establishment이스태블리시먼트 registration.^r레지스트^r레이션

② 지식재산처장은 다음 각 호의 어느 하나에 해당하는 경우에는 상표권을 설정하기 위한 등록을 하여야 한다. <개정 2025.10.1>

(2) In인 any에니 of어^v브 the^ð더 following^f팔로잉 cases,케이시즈 the^ð더 Minister미너스터 of어^v브 Intellectual인털렉추얼 Property프^r라퍼티 shall섈 make메이크 a어 registration^r레지스트^r레이션 to투 establish이스태블리시 a어 trademark트^r레이드마크 right:^r라잇

1. 제72조제3항 또는 제74조에 따라 상표등록료(제72조제1항 각 호 외의 부분 후단에 따라 분할납부하는 경우에는 1회차 상표등록료를 말하며, 이하 이 항에서 같다)를 낸 경우

1. 2. 제76조제2항에 따라 상표등록료를 보전하였을 경우

③ 지식재산처장은 제2항에 따라 등록한 경우에는 상표권자의 성명ㆍ주소 및 상표등록번호 등 대통령령으로 정하는 사항을 상표공보에 게재하여 등록공고를 하여야 한다. <개정 2025.10.1>
