전남광주통합특별시 설치를 위한 특별법 제10조(통합특별시의 관할구역에 두는 시ㆍ군ㆍ구의 지위 및 권한 특례)

① 통합특별시 관할구역의 시ㆍ군은 「지방자치법」 등 관계 법령에도 불구하고 통합 전의 시ㆍ군이 수행하던 사무와 권한을 그대로 유지한다. 통합특별시장은 통합을 이유로 시ㆍ군의 행정상ㆍ재정상 권한을 축소하거나 불이익을 주어서는 아니 된다.

② 통합특별시는 이 법에 따라 중앙행정기관의 권한 또는 재원을 이양받은 경우 시ㆍ군ㆍ구의 자치권 및 행정기능 강화를 위하여 권한ㆍ사무ㆍ재정의 배분 및 지원에 대한 이양계획을 수립ㆍ시행하여야 하며, 이에 필요한 사항은 통합특별시조례로 정한다.

③ 통합특별시장은 통합특별시 관할구역 내의 자치구와 시ㆍ군 간 자치 역량의 불균형을 해소하기 위하여 다음 각 호의 사항을 포함하는 자치권 강화 방안을 마련하여 시행하여야 한다.

④ 통합특별시의 사무는 주민의 복리 증진과 행정의 효율성을 위하여 시ㆍ군ㆍ구가 우선적으로 처리하도록 배분하는 것을 원칙으로 하며, 통합특별시장은 광역행정 수요 대응 등 특별한 사유가 없으면 통합특별시의 권한과 사무를 시ㆍ군ㆍ구로 포괄적으로 이양하도록 노력하여야 한다.

⑤ 제4항에 따라 이양된 사무에 관하여는 해당 시ㆍ군ㆍ구의 장을 관계 법령에 따른 주무관청으로 본다.
